Özet
Asr-ı saadetten itibaren Hz. Peygamberin sözleri ve uygulamaları hakkında çeşitli amaçlarla sorulan sorular, h.III/ m.IX. asırdan sonra cevaplarıyla beraber müstakil eserlerde yer almaya başlamıştır. Bu eserlerin ortak özellikleri, bize hadîs edebiyatı içerisinde“el-fetâva'l-hadîsiyye”ismiyle oluşmuş bir türden bahsetme imkânı vermektedir. Buna göre hadîslerin kaynağı, râvîleri, sıhhati ve yorumu, çelişkili gözüken hadîsler, herhangi bir konuda hadîs olup olmadığı, halk arasında şöhret bulmuş bazı rivâyetlerin değerlendirilmesi, Hz. Peygamber, ashâbı ve diğer peygamberler ile ilgili birtakım konular ve hadîs ilimlerinin teknik meseleleri hakkındaki sorulara verilen cevaplar ile çeşitli konularda hadîsler ışığında verilmiş fetvâlara“el-fetâva'l-hadîsiyye”, bunları ihtiva eden eserlere de“el-fetâva'l-hadîsiyye eserleri”denir. Tezde literatürde yapılan taramayla tespit edilen bazı eserlerin okunması, incelenmesi, ortak ve farklı özelliklerinin belirlenmesi ve değerlendirilmesi şeklinde bir yöntem takip edilmiştir. Tez, belirtilen asırlarda seçilen eserler kapsamında, müslüman toplumların hangi konulara ve hadîslere ilgi duyduklarını ortaya koyması açısından önem taşımaktadır. Birden fazla eserde tekrarlanan fetvâların ortak ve farklı yönleri ile konunun ele alınış şekli hem eserlerin müelliflerinin tanınmasına katkıda bulunmakta hem de konuyla ilgili süreç içerisinde bir gelişim olup olmadığını göstermektedir. Ayrıca tamamen veya kısmen hadîs fetvâlarından oluşan bu eserlerde yer alan bazı soruların çağımızda da zaman zaman gündeme geldiği görülmektedir. Pek çok konuda çeşitli âlimlerin görüş ve kanaatlerine dair bilgi bulabileceğimiz bu kitapların bazılarında hadîslerle ilgisini ve niçin sorulduğunu tespit edemediğimiz bazı sorular da yer almaktadır.

Questions asked for various purposes about the words and practices of the Prophet since the age of Bliss began to take place in independent works with their answers after the third century of Hijri / nineth century of Gregorian. The common features of these works give us the opportunity to talk about a genre formed under the name of“el-Fetava'l-Hadithiyye”in Hadith Literature. Accordingly, the source of the hadiths, their narrators, their authenticity and interpretation, the hadiths that seem contradictory, whether there is a hadith on any subject, the evaluation of some famous narrations among the people, some issues related to the Prophet, his companions and other prophets, and the answers given to the questions about the technical issues of hadith sciences and the fatwas given in the light of hadiths on various subjects are called“al-Fetava'l-Hadithiyye”, and the works containing them are called“al-Fetava'l-Hadithiyye works”. In the thesis, a method has been followed in the form of reading, examining, determining and evaluating common and different features of some works that were determined by scanning in the literature. The thesis is important in terms of revealing which subjects and hadiths Muslim societies are interested in within the scope of the works selected in the specified centuries. The common and different aspects of the fatwas repeated in more than one work and the way the subject is handled both contribute to the recognition of the authors of the works and show whether there is a development in the process related to the subject. In addition, it seems that some of the questions in these works, which are composed entirely or partially of hadith fatwas, come to the fore from time to time in our age. In some of these books, where we can find information about the views and opinions of various scholars on many subjects, there are also some questions that we could not determine their relevance to hadiths and why they were asked.
