Özet
Son yıllarda tıp teknolojisinin gelişmesiyle ve sosyal medyada kalıplaşmış güzellik algısı sebebiyle güzelleştirme amaçlı tıbbi müdahaleye başvurma oranı da artmıştır. Daha önceki dönemlerde yalnızca zenginlerin yaptırabildiği, ulaşılması zor olan bu müdahalelere günümüzde ulaşma imkânı da artmaktadır. Hal böyle iken yapılan müdahalelerde istenmeyen sonuçların ortaya çıkma ihtimali de gün geçtikçe artmaktadır. Çalışmamızın amacı güzelleştirme amaçlı tıbbi müdahalelerde hekimin hastaya karşı hukuki sorumluluğunu detaylı şekilde inceleyerek katkı sağlamaktır. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde tıbbi müdahale ve güzelleştirme amaçlı tıbbi müdahale kavramları açıklanmış, güzelleştirme amaçlı tıbbi müdahalelerin hukuka uygunluk şartları incelenmiş ve güzelleştirme amaçlı tıbbi müdahalelerde hekim ile hasta arasındaki hukuki ilişkinin niteliği konusunda doktrindeki görüşler tartışılarak hekim ile hasta arasındaki hukuki ilişkinin niteliğine ilişkin kanaat elde edilmiştir. İkinci bölümde, hekimin ve hastanın hem genel yükümlülükleri hem de eser sözleşmesinden kaynaklanan yükümlülükleri ayrı ayrı ele alınmıştır. Üçüncü bölümde ise, hekimin hukuki sorumluluğuna ilişkin kavramlar incelenmiş, hekimin hukuki sorumluluğu hekim ile hasta arasındaki hukuki ilişki türüne göre ayrı ayrı ele alınmış, hekimin hangi hallerde sorumluluğunun doğacağı ve hangi hallerde sorumluluğunun sona ereceği incelenmiştir. Üçüncü bölümün son kısmında ise, güzelleştirme amaçlı tıbbi müdahalelerle ilgili bazı yargı kararları incelenmiştir.

In recent years, with the development of medical technology and the stereotyped perception of beauty in social media, the rate of seeking medical intervention for beautification has also increased. Today, the possibility of accessing these interventions, which were difficult to reach, which could only be done by the wealthy in the past, is increasing. In the meantime, the possibility of undesirable results in the interventions is increasing day by day. The aim of our study is to contribute by examining in detail the legal responsibility of the physician towards the patient in medical interventions for beautification. Our work consists of three parts. In the first part, the concepts of medical intervention and medical intervention for the purpose of beautification are explained, the legality conditions of medical interventions for beautification are examined and the opinions in the doctrine about the nature of the legal relationship between the doctor and the patient in the medical interventions for the purpose of beautification are discussed, and an opinion on the quality of the legal relationship between the doctor and the patient is obtained. In the second part, both the general obligations of the physician and the patient and the obligations arising from the contract of work are discussed separately. In the third chapter, the concepts related to the legal responsibility of the physician were examined, the legal responsibility of the physician was discussed separately according to the type of legal relationship between the physician and the patient, and in which cases the physician's responsibility would arise and in which cases his liability would end. In the last part of the third part, some judicial decisions about medical interventions for beautification are examined.
