As seen in various incidents, market abuse crimes can destroy economic infrastructure as a whole, both on domestic and global scopes. Especially after 2008 Global Financial Crisis, the combat against such crimes became a top prioritized issue on the EU level amongst other policies. Hereby, Turkey, gave an effort to shape its' market abuse regulations based on the EU legal acquis in order to fulfil the Copenhagen Criteria that has been set for the prospective EU member states. To this end, a comparative legal analysis between the EU and Turkish substantive laws on market abuse became essential to foresee Turkey's performance on aligning itself to the EU standards. The definitions of criminal acts and anticipated sanctions from both frameworks are analysed through black-letter methodology, and found as vastly aligned with each other. Moreover, in order to complement the substantive law analysis, law enforcement practices of both jurisdictions are compared via quantitative and qualitative (interview) methods. Through this, the enforcement practice of Turkey is found to be contrary to EU's law enforcement policy that is based on the dominance of criminal law. The result of the present thesis serves as a contribution for throwing light upon the future EU-Turkey relations and Turkish accession process.
