Özet

Ahkâm tefsirleri, Kur'ân'ın hüküm ifade eden âyetlerini konu edinmektedir. Hz. Peygamber döneminde âyetin ne mânaya geldiği, hüküm ifade edip etmediği, bizzat Hz. Peygamber'den öğrenilip anlaşılabiliyordu. Bu anlama faaliyeti Hz. Peygamber'den sonra yedi harf ruhsatının da etkisiyle kırâat farklılıklarının ortaya çıkmasına ve devamında değişik mânalara gelmesine dolayısıyla da farklı hükümlere varılmasına sebep olmuştur. Bir giriş, üç bölüm ve bir sonuçtan oluşan bu çalışmada kırâat farklılıklarını esas alarak, el-Cessâs ve el-Kurtubî tefsirleri mukârene edilerek incelenmiştir. Giriş bölümünde çalışmanın konusu, amaç, yöntem ve kapsamıyla ilgili bilgiler verilirken istifade edilen belli başlı kaynaklar açıklanmıştır. Birinci bölümde kırâat ilmi ile ilgili temel bilgiler verildikten sonra kırâat ilminin tefsir ve fıkıh alanında yorum farklılıklarına etkisi ve her iki tefsirin müellifi hakkında özet bilgi de birinci bölümde yer almaktadır. İkinci bölümde el-Cessâs ve el-Kurtubî'nin eserlerinde tefsir, hadis, fıkıh, kelâm, dil ve tarih gibi faydalandıkları kaynakları ve müfessirlerin tefsir usûlü ve fıkıh usûlü ile ilgili kullandıkları metotları ve yaklaşımlarını ele aldık. Üçüncü bölümde ise müfessirlerin kırâatlere yaklaşımı ve buradan hareketle hüküm çıkarma tercihleri işlenmiştir. Sonuç bölümünde ise ulaşılan hedef, görülen eksiklikler ve araştırmacılara yapılan tavsiyeler yer almıştır.

Ahkam tafsir deals with the verses of the Qur'an that express judgment. Hz. What the verse meant during the Prophet's time, whether it was a decree or not, was revealed by the Prophet himself. It could be learned and understood from the Prophet. This understanding activity After the Prophet, with the effect of the seven letter license, it caused the differences in recitation to emerge and subsequently to have different meanings and thus to arrive at different judgments. In this study, which consists of an introduction, three chapters and a conclusion, the tafsir of al-Jaṣṣās and al-Qurtubi have been examined, based on the differences in recitation. In the introduction part, the main sources used while giving information about the subject, purpose, method and scope of the study are explained. In the first chapter, after giving basic information about the science of recitation, the effect of the science of recitation on the differences in interpretation in the field of tafsir and fiqh, and summary information about the author of both tafsir, is also included in the first chapter. In the second part, we discussed the sources used by al-Jaṣṣās and al-Qurtubi such as tafsir, hadith, fiqh, theology, language and history, and the methods and approaches of tafsir tafsir about tafsir and jurisprudence. In the third part, the approach of the commentators to the recitations and their preferences to make judgments based on this are discussed. In the conclusion part, the target reached, the deficiencies observed and the recommendations made to the researchers are included.
