Özet
Üstlendikleri görevler ve bu görevler nedeniyle artan personel sayısı ve akçal kaynakları ile yönetsel yapı içinde önemli yere sahip olan belediyelerin, istihdam ettiği personelin cezai sorumluluğu; bu sorumluluğu doğuran koşullar ile birlikte üç ana bölümde incelendi. Çalışmanın birinci bölümünde belediye personelinin Devlet Memurları Kanunu, belediye kanunu ve çeşitli mevzuat hükümlerine göre sorumlulukları ve öngörülen özel ceza yaptırımlarına yer verilmiştir. Çalışmanın ikinci bölümünde, belediyelerin üstlendiği kamu hizmetlerinin yürütücüsü olan belediye personelinin kanun, tüzük ve yönetmeliklere aykırı davranışları nedeniyle haklarında uygulanması söz konusu olan disiplin hukuku, bu konudaki temel yasa olan Devlet Memurları Kanununun sistematiği içinde, örnek olaylar ve yargı kararları ışığında incelenmiştir. Tezin üçüncü bölümünde, belediye personelinin yargılama süreci incelenirken, belediye personelinin de tabi olduğu memur yargılaması sistemi, bu sistemin belli başlı organları, kurumları ve kuralları detaylıca ortaya konulmaya çalışılmıştır. Elverdiğinde sisteme özelliğini veren önemli noktalar gözden kaçırılmadan; konunun kısa tarihçesi, belediye personelindeki uygulaması ve teoride tartışılan sorunlar ile uygulamada beliren aksaklıklar ele alınmaya çalışılmıştır. İkinci ve üçüncü bölümdeki konular incelenirken, belediye personelinin seçimle ve atamayla gelme durumu ve atananların istihdam biçimleri uyarınca tabi oldukları hukuki statüler ve bu statülere göre uygulama farklılıkları belirginleştirilmiştir. Çalışmanın sonunda, ele alınan konular hakkında değerlendirme, sorunlar ve çözüm önerilerine yer verilmiştir.

The criminal liability of the municipal staff, who have an important location in the administrative structure with the financial sources and the tasks they have undertaken and the staff number which has increased due to those tasks, has been studied in detail in three main parts along with the conditions that have led to that liability. In the first part of the study, the law of goverment officials of the municipal staff, municipal law and the tasks according to the various legislative provisions and lastly, anticipated private penal sanctions have been included. In the second part, The law of discipline, which is considered to be implemented on the municipal staff, who are the executives of the public services that municipalities have taken on, because of their behaviors against the law and the regulations, has been discussed in the system of the law of government officials, which is the main code in this matter and in the light of legislative decrees and the sample events. In the third of the study, The process that municipal staff are judged has been studied. Moreover, the system of the judgement of civil servant that municipal staff are also dependent on, the main organs, institutions and rules of the system have been tried to be brought up in detail. It can be stated that the short history of the topic, the implementation on municipal staff, the troubles faced in theory and in practice have been scrutinezed by taking the essential points in the system into consideration. While studying on the subjects in the second and the third parts, the occasion of the municipal staff who came by election or appointment, the legal statutes which the appointed people are dependent on in accordance with their employment styles and the application difference according to those statutes have been stated. In the conclusion part of the study, the evaluation about the subjects and also the problems and the ways of solving them have been included.
