Özet
“Konut ve Çatılı İşyeri Kiralarında Kiracının Kira Bedelini ve Yan Giderleri Ödemede Temerrüdü (TBK m.315) ve İki Haklı İhtar Sebebiyle Tahliye (TBK m.352/2)”başlıklı bu tez çalışmamda öncelikle kira sözleşmelerinin hukuki tanımı ve niteliği ele alınmıştır. Kira bedeli ve yan giderler kavramı açıklanmaya çalışılarak kiracının kira bedelini ve yan giderleri ödemede temerrüdü ve hukuki sonuçları ve genel olarak kira sözleşmesinin sona erme hallerine değinilmiştir. Devamında konut ve çatılı işyeri kiralarında kiracının kira bedelini ve yan giderleri ödemede temerrüdü nedeniyle TBK m.315 çerçevesinde kira sözleşmesinin feshi incelenmiştir. Bunun ardından ise konut ve çatılı işyeri kiralarında kiracının kira bedelini zamanında ödememesinden dolayı iki haklı ihtar sebebiyle tahliye başlığı altında iki haklı ihtar sebebiyle tahliyenin şartları ve tahliye davasının açılmasına ilişkin bilgilere yer verilmiştir. Konular ele alınırken öğretide sıkça tartışma konusu olan noktalara değinilmeye çalışılmış, bu hususlarda yüksek yargı kararlarına ve uygulamalarına da yer verilerek çözüm önerileri getirilmiştir.
Özet (Çeviri)
In this thesis titled“Renter's Default in Paying the Rent and Additional Costs in Residential and Roofed Workplace Rents (Article 315 of the Turkish Code Of Obligations) and Eviction Due to Two Justified Warnings (Article 352/2 of the Turkish Code Of Obligations)”, the legal definition and nature of the rental contract were primarily discussed. The concept of rent and additional costs is tried to be explained and the default and legal consequences of the tenant in paying the rent and additional costs and the termination of the rental contract in general are mentioned. Subsequently, the termination of the rental contract within the framework of Article 315 of the Turkish Code Of Obligations due to the renter's default in paying the rent and additional costs in residential and roofed workplace rents was examined. Following this, under the heading of eviction due to two justified warnings due to the renters failure to pay the rent on time in residential and roofed workplace rents, information on the conditions of the eviction due to two justified warnings and the opening of the eviction case were included. While discussing the issues, the points that are frequently discussed in the doctrine were tried to be mentioned, and solutions were proposed by including high judicial decisions and practices in these issues.
