Özet

Bu çalışmada, 5237 sayılı Türk Ceza Kanunu'nun“Millete ve Devlete Karşı Suçlar ve Son Hükümler”başlıklı 4. kısmı altında“Adliyeye Karşı Suçlar”isimli 2. bölümü kapsamında 270. maddede düzenlenen suç üstlenme suçu incelenmiştir. Doktrinde ve yargı kararlarında günümüzde hala pek çok tartışmaya sebebiyet veren bir suç tipi olan suç üstlenme suçu, kişilerin farklı saiklerle çokça başvurduğu bir yöntem olarak karşımıza çıkmaktadır. Bu bağlamda, suç üstlenme suçunun hukuki değerlendirmesinin doğru şekilde yapılması ve tartışmaların açıklığa kavuşturulması, uygulama açısından önem arz etmektedir. Çalışmamız kapsamında, suç üstlenme suçuna ilişkin doktrinde, özellikle içtihatlar doğrultusunda ortaya çıkan tartışmalar tespit edilmiş ve açıklığa kavuşturulmaya çalışılmıştır. Özellikle suçun failinin isnat altında olan bir kişi olup olamayacağı hususu savunma hakkının sınırları bağlamında irdelenmiş; suçun konusuna ilişkin kanun lafzından kaynaklanan“uydurma bir suç üstlenilebilir mi?”sorununa çözüm getirilmeye çalışılmıştır. Bu bağlamda suç üstlenme suçunun işlenmesi ile eş zamanlı şekilde ortaya çıkabilecek belgede sahtecilik suçları ve resmi belgede yalan beyan suçu değerlendirilmiş; suç üstlenme suçuna doğası itibarıyla benzeyen suç uydurma, suçluyu kayırma ve iftira gibi suçlar ile gündeme gelebilecek içtima problemleri çözüme kavuşturulmaya çalışılmıştır.

In this study, the crime of false confession is examined, which is regulated in Article 270 of the Turkish Penal Code No. 5237, under the 2nd section named“Crimes Against the Judicial Organization”of the 4th chapter titled“Crimes Against the Nation and the State and Final Judgments”. The crime of false confession, which is a type of act that still causes many debates in doctrine and jurisprudence, appears as a method that people resort to often with different motives. In this context, it is important for practice to correctly characterize the crime of false confession and to clarify the discussions. Within the scope of our study, the debates that emerged in the doctrine under the crime of false confession, especially in accordance with the jurisprudence, are identified and tried to be clarified. In particular, the issue of whether the offender of the crime could be a person under accusation is examined in the context of the limits of the right to defense; also delivering a solution is aimed on the question of“can a fabricated crime be undertaken?”. In this context, the crimes regulated regarding forgery of documents and the crime of false statement in the official document that may occur simultaneously with the committing of the crime of false confession are evaluated; in addition to this the problems, which may occur about aggregation of crimes, are tried to be clarified that may come up with crimes such as fabricating a crime, the crime of helping the offender and slander, which are similar in nature to the crime of false confession.
