Özet
Kadıların Osmanlı sistemindeki etkin rolleri sebebiyle şer'iyye sicilleri sosyal ve yerel tarih çalışmalarında ana kaynak niteliği taşımaktadır. Osmanlı tarihi kaynakları içerisinde çok önemli yeri bulunan bu belgeler tanıklık ettiği döneme ışık tutan özgün kaynaklardır. Bunlar Osmanlı Devleti mahkemelerinde verilen kararların ve tutulan kayıtların toplandığı defterlerdir. Kadı sicilleri, kadı divanı, mahkeme kayıtları, sicillât-ı şer'iyye ve yaygın kullanımı ile şer'iyye sicilleri denilen bu defterler kadı yahut nâibi tarafından tutulmakta ve çeşitli türden belgeleri içermektedir. Yüksek lisans tezi olarak incelediğimiz 419 Numaralı Manisa Şer'iyye sicilini (1326-1329/1908-1911); konu bakımından tespit ettiğimiz dava kayıtlarının ağırlıklı olarak, miras, talak, vasi tayini, satış ve alacak davalarını içeren hüccet ve berat türü belgeler olduğunu görmekteyiz. Bu çalışma ile Manisa Sancağı Kula Kazası yerelinde yaşanan olayların; dönemin ekonomik, sosyal, kültürel ve hukuki durumuna ışık tutacağına inanıyoruz. Çalışmamız, giriş ve üç bölümden oluşmaktadır. Giriş kısmında çalışmanın konusu, amacı ve yöntemi belirtilerek, Manisa ve Kula Kazası'nın coğrafi ve tarihî durumu ele alınmaktadır. Ardından birinci bölümde Osmanlı klasik dönem hukuku ve kadılık kurumu, son olarak Tanzimat dönemi hukuku ve mahkemeleri hakkında genel bilgi verilmiştir. İkinci bölümde Manisa Şer'iyye Sicilleri, 419 Numaralı sicil defterinin tanıtımı, belge özetleri ve transkribi, üçüncü bölümde ise sicilin genel değerlendirmesi yapılmış, defterde geçen dava konuları ve yer adları hakkında bilgi verilmiştir. Çalışma sonuç, ekler ve kaynakça ile son bulmaktadır.

Due to the active role of the kqadi's in the Ottoman system, legal registers are the main source for social and local history studies. These documents, which have a very important place among the sources of Ottoman history, are unique sources that shed light on the period they witnessed. There are notebooks in which the decisions made and records kept in the courts of the Ottoman Empire are collected. These books, called kqadi registers, kqadi divan, court records, legal registers and, in common usage, sharia registers, were kept by the kqadi or his regent and contained various types of documents. When we examine the Manisa Sharia Registry No. 419 (1326-1329/1908-1911), which we identified as a master's thesis, in terms of subject matter, we see that the case records are mainly documents of the type of docket and warrant, including inheritance, talaq, appointment of guardian, sale and debt cases. With this study, we believe that the events in Manisa will shed light on the economic, social, cultural and legal situation of the period. Our study consists of an introduction and three chapters. İn the introduction , the subject, purpose and method of the study are stated and the geopraphical and historical stuation of Manisa and Kula district is discussed.Then in the first part, general information is given aboutOttoman Classical period lawand the instution of judgeship,and finally about Tanzimat period law and courts. İn the second part, Manisa Sharia Registries, the introduction,document summaries and transcripts of the registry book no.419, and in the third part, a general evaluation of the registry was made and information was given about the case subjects and place names in the book. The study ends with conclusion, appendices and bibliography.
