Özet
Bu çalışmanın konusu“Hükümlü ve Tutuklu Hakları ile Hak Kullanımı ve Beslenmeyi Engelleme Suçu”dur. Hak kullanımı ve beslenmeyi engelleme suçunun birinci fıkrasında ceza infaz kurumlarında bulunan tutuklu ve hükümlülerin haklarının engellenmesi yaptırım altına alınmıştır. Maddenin ikinci fıkrasında ise tutuklu ve hükümlülerin beslenme hakkı düzenlenmiş olup bu hakkın engellenmesi suç sayılmış aynı zamanda hükümlü ve tutukluların açlık grevine veya ölüm orucuna teşvik veya ikna edilmeleri ya da bu yolda kendilerine talimat verilmesinin de beslenmenin engellenmesi sayılacağı belirtilmiştir. Üçüncü fıkrada özel bir içtima kuralı getirilerek beslenmenin engellenmesi nedeniyle kasten yaralama suçunun neticesi sebebiyle ağırlaşmış hallerinden biri veya ölüm meydana gelmesi halinde ayrıca kasten yaralama veya kasten öldürme suçlarına ilişkin hükümlere göre cezaya hükmolunacağı belirtilmiştir. Bu çalışmada 298. madde kapsamında belirtilen hakları engellenen tutuklu ve hükümlülerin Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi'ne yaptıkları başvurular incelenmiş, hakların kullanımı hususunda devletin üzerine düşen yükümlülüklerini yerine getirip getirmediği, ceza infaz kurumu yönetiminin ve personelinin rolü ele alınmıştır. Ayrıca hükümlü ve tutukluların sahip olduğu haklar konusunda karşılaştırmalı hukuktaki düzenlemelere yer verilmiştir.

The subject of our study is Rights of Convicts and Detainees and The Crime Of Preventing The Exercise Of Rights and Nutrition. In the first paragraph of the crime of preventing the use of rights and nutrition, obstructing the rights of detainees and convicts in penal institutions is sanctioned. In the second paragraph of the article is regulated the right to food of detainees and convicts and obstructing this right is considered a crime. At the same time encouraging or persuading them to go on a hunger strike or death fast, or giving them instructions in this regard, is also constitutes the crime of obstructing nutrition. A special assembly rule is regulated in the third paragraph. According to regulation if one of the serious crimes of intentional injury or death occurs due to obstruction of nutrition, the person will also be punished for the crime of deliberately injuring or delibrate killing. In this study, the applications made by detainees and convicts to the Constitutional Court and the European Court of Human Rights were examined. And also, it was examined exercise of convicts rights whether the state fulfilled its obligations regarding or not. With this the role of the prison administration and staff regarding the convict's exercise of his/her rights was examined. Finally, it is discussed regulations in comparative law regarding the rights of convicts and detainees.
