Özet
Amacı maddi gerçeğe ulaşmak olan ceza muhakemesi, soruşturma ve kovuşturma evresi olmak üzere iki evreden oluşmaktadır. Sanığın, ceza muhakemesinin bir süjesi olan yargılama makamı tarafından yargılandığı ve özgürlüğünü tehdit edebilecek bir hüküm ile sonuçlanabilecek kovuşturma evresine hazırlık niteliğinde olan soruşturma evresinde, şüpheliyi/sanığı mahkumiyete götürebilecek deliller toplanmakta ve kovuşturma evresi için hazırlanmaktadır. Dolayısıyla soruşturma evresi, kovuşturma evresinin temelini oluşturmaktadır. Ceza muhakemesinde böylesi bir öneme sahip olan evrede şüphelinin müdafi yardımından yararlanması da adil, hakkaniyete ve hukuka uygun ve çelişmeli bir yargılamanın yapılması için önemli ve gereklidir. Zira bu evrede şüpheli, müdafi yardımından yararlanmak suretiyle soruşturma ve kovuşturma mercilerinin haklarına, hukuka ve hakkaniyete uygun davranmasını sağlayacak bir kontrol mekanizmasını devreye sokmuş olacaktır. Müdafi de kendisine tanınan yetkileri kullanmak ve yüklenen yükümlülükleri yerine getirmek suretiyle şüphelinin/sanığın haklarını etkili bir savunma görevi icra ederek korumuş olacaktır. İşte bu yetki ve yükümlülükler, şüpheli ile müdafi arasındaki ilişkinin özünü oluşturmaktadır. Bu anlamda, yetkilerini gereği gibi kullanmayan veya yükümlülerini yerine getirmeyen bir müdafi ile şüpheli arasında sağlıklı bir ilişkinin olduğu da söylenemeyecektir. Bu çalışmada da müdafiin soruşturma evresindeki yetki ve yükümlülüklerine ve bunlara ilişkin sorunlara değinilerek müdafiin, şüpheli ile olan ilişkisini nasıl geliştirmesi ve ilerletmesi gerektiği yönünde yol gösterici olmaya çalışılacaktır.

Criminal procedure, the purpose of which is to reach the material truth, consists of two stages: investigation and prosecution. During the investigation phase, in which the accused is tried by the judicial authority, which is a subject of criminal procedure, and which is in preparation for the prosecution phase, which may result in a verdict that may threaten his freedom, evidence that may lead the suspect/accused to conviction is collected and prepared for the prosecution phase. Therefore, the investigation phase forms the basis of the prosecution phase. At such an important stage in criminal procedure, the fact that the suspect benefits from the assistance of a public defender is also important and necessary for a fair, lawful and contradictory trial to be carried out. Because, at this stage, the suspect will have activated a control mechanism that will ensure that the investigation and prosecution authorities act in accordance with their rights, law and equity by benefiting from the assistance of the defense. By exercising the powers conferred on him and fulfilling the obligations imposed on him, the defender shall protect the rights of the suspect/accused by performing an effective duty of defence. These powers and obligations constitute the essence of the relationship between the suspect and the defender. In this sense, it cannot be said that there is a healthy relationship between a defender and a suspect who does not properly exercise his powers or does not fulfill his obligations. In this study, the powers and obligations of the defense attorney during the investigation phase and the problems related to them will be addressed and it will be tried to guide how the defense should develop and advance his relationship with the suspect.
