Özet
Bu çalışmada kişilik hakkı ve kişilik hakkını oluşturan başlıca değerlere değinilmiş; itibar türleri, tacirler ve esnafların piyasada sahip olduğu ticari itibar ve ticari itibarı zedeleyen başlıca faktörler incelenmiştir. Ticari itibarın korunması ikili bir ayrım çerçevesinde irdelenmiştir. Bunlar“Ticari itibarın kişinin rızası ile gerçekleşen ihlallerden korunması”ve“Ticari itibarın kişinin rızası dışında gerçekleşen ihlallerden korunması”dır. Ayrıca ticari itibar kaybı karşısında tacirlerin ve esnafların sahip olduğu hukuki imkânlar çalışmanın kapsamına dâhil edilmiştir.

In this study, the personal right and the basic values that constitute the personal right was mentioned; types of reputation, in the market the commercial reputation of traders and artisans and main factors that damage commercial reputation was examined. Protection of the commercial reputation was scrutinized within the scope of a binary dinstiction. These are“Protection of commercial reputation from violations occurring with the consent of the person”and“Protection of commercial reputation from violations occurring without the consent of the person”. In addition, the legal possibilities of traders and artisans in face of loss of commercial reputation were included in the scope of the study.
