Özet
Çalışmamızda, Mâlikî mezhebi fetvalarında bulunan mutemed görüşten dönme (udûl) meselesi ele alınmıştır. Çalışmada fetva mefhumu, Mâlikî mezhebinde mutemed olan görüş kavramı tanımlanmış ve bunun muhtelif dereceleri belirlenerek nasıl öğrenileceği izah edilmiştir. Ayrıca, mezhepte mevcut olan görüşler arasında tercih yapma kaideleri ve konu hakkında uygulanan yöntem analiz edilmiştir. Yine fetvalarda mutemed görüşten dönme kavramı, bu kavramla ilişkili ıstılahlar -örneğin istihsan, mâ cerâ bihi'l-amel, mürâât-ı-hilâf- açıklanmış ve Mâlikî mezhebinin bu konudaki görüşleri tartışılarak mezhep içerisindeki râcih görüş belirlenmiştir. Öte yandan, örf, maslahat, zarûret ve meşakkatin kaldırılması (ref'u'l-harec) gibi fetvalarda mutemed görüşten sapmayı gerektiren şer'î sebeplerin temeli açıklanmış ayrıca Mâlikî fetvalarından birtakım örnekler verilmiştir. Böylece teorik kısım, mezhep içerisinde mutemed olan görüşten dönme durumunda uyulması gereken kurallar detaylandırılarak nihayete erdirilmiştir. Uygulama bölümünde ise, Libya Dârü'l-İftâ tarafından mutemed olan görüş noktasında sapılan fetvalar incelenmiş ve bu sapmalarda uyulması gereken kuralların denetlenme noktası tartışılmıştır. Çalışmamızın ulaştığı sonuçlardan bazıları şunlardır: Mâlikî mezhebindeki fetvalarda mutemed görüşten sapma, şer'î sebeplerle ve geçerli denetim kurallarına uyulduğunda uygulanabilmektedir. Öyle ki belirtilen dönme sebepleri, Mâlikî mezhebinin temel prensiplerine uygundur. Libya Dârü'l-İftâ'nın mutemed görüşten sapılarak verilen fetvaların çoğu dikkate değer bir nedene dayanmakta olup, bazı fetvalarda ise görüşten dönme ile ilgili uyulması gereken kurallar ihmal edilmiştir. Bu uyulması gereken kurallar arasında meseleye dair doğru bir kavrayış, sapılan görüşün doğruluğu ve söz sahibinden sahih bir şekilde aktarımı gibi unsurlar yer almakla beraber dönme gereksiniminin kendisine sapılan görüşte bulunmaması yer almaktadır.

The research addresses the issue of departing from the established opinion in the Maliki school of jurisprudence in fatwas. It discusses the concept of fatwa, the concept of the established opinion in the Maliki school, and then presents the methods of recognizing it by examining its ranks, the principles of prioritizing opinions within the school, and analyzing the methodology followed in this regard. The research also clarifies the concept of departing from the established opinion in fatwas and its relationship with related terms such as istihsan (juristic preference), customary practice, and considering differing opinions. Additionally, it explains the ruling on departing from the established opinion according to the Maliki scholars by mentioning and discussing their views, and then presenting the most preponderant view. Furthermore, the research highlights the legal justifications for departing from the established opinion, which include custom, public interest, necessity, and alleviation of hardship. These justifications are explained through their legal foundations and examples from Maliki fatwas. The theoretical section concludes by detailing the regulatory criteria to be observed when departing from the established opinion. The practical section of the research examines fatwas issued by the Libyan Dar al-Ifta where the established opinion was deviated from, analyzing them in terms of whether the criteria for departure were met, and considering other relevant factors. Among the conclusions reached by the research are that departing from the established opinion in fatwas is acceptable in the Maliki school if there are legitimate reasons accompanied by the required regulatory criteria, that the justifications for departure are aligned with the principles of the Maliki school, and that most of the fatwas issued by the Libyan Dar al-Ifta, where the established opinion was deviated from, have valid justifications, except for some fatwas where the regulatory criteria were overlooked, such as the correct understanding of the issue, the strength of the opinion deviated to, its correct transmission from its proponents with all conditions and constraints met, and ensuring that the justification for departure is fulfilled in the opinion deviated to, not the established opinion.
