Özet
Kişisel veri, kimliği belirli ya da belirlenebilir gerçek kişiye ilişkin her türlü veridir. Kişisel verilerin özel nitelikli bir türü olan kişisel sağlık verileri ise, yine kimliği belirli ya da belirlenebilir gerçek kişiye ilişkin her türlü sağlık verisidir. Günümüzdeki teknolojik gelişmeler doğrultusunda bu verilerin ulaşılabilirliğinin artması, korunması hususunun da giderek daha fazla önemli hale gelmesi sonucunu doğurmaktadır. İki bölümden oluşan çalışmamızın ilk bölümünde, kişisel veri kavramının tam olarak ne ifade ettiğinin ve hukuki niteliğinin belirlenmesi suretiyle, tarihsel gelişmeler doğrultusunda neden korunması gerektiği hususu incelenecektir. İkinci bölümde ise, kişisel verilerin özel nitelikli bir türü olan sağlık verilerine ilişkin açıklamalara yer verilerek, bu verilerin özel nitelikli bir veri türü olarak kabul edilmesinin temel sebebine ilişkin araştırmalarımız doğrultusunda, bu verilere yönelik koruma yöntemlerinden bahsedilecektir. Yine bu bölümde, bir kişilik değeri olarak ele aldığımız kişisel sağlık verilerinin, söz konusu koruma yöntemlerinden biri olan kişilik hakkı kapsamında korunması hususu, Türk hukuk sistemindeki kişiliğin korunmasına ilişkin hükümler çerçevesinde değerlendirilecektir.

Personal data is any data relating to an identified or identifiable natural person. Personal health data, which is a special type of personal data, is any kind of health data relating to an identified or identifiable natural person. In accordance with today's technological developments, the increasing accessibility of these data leads to the fact that the protection of these data is also becoming increasingly important. In the first part of our study, which consists of two parts, by determining exactly what the concept of personal data means and its legal nature, the reasons why it should be protected in accordance with historical developments will be examined. In the second part, explanations about health data, which is a special type of personal data, will be given and protection methods for this kind of data will be mentioned in accordance with our research on the main reason why this data is considered a special type of data. Also in this part, as one of these protection methods, the protection of personal health data which we consider as a personal value will be evaluated within the scope of the right of personality and the framework of the provisions regarding the protection of personality in the Turkish legal system.
