Özet
Destekten yoksun kalma tazminatı, hukukumuzda TBK m.53 ile kanun koyucu tarafından tazmini öngörülen istisnai bir tazminat türüdür. Destekten yoksun kalma zararı, geleceğe yönelik bir zarar olduğundan, niteliği gereği hesaplanması birçok bilinmeyeni içermekte, bu durum farklı uygulamaları gündeme getirmektedir. Çalışmamızın konusunu oluşturan iş kazası ve meslek hastalığından kaynaklanan destekten yoksun kalma tazminatı, SGK'nın rücu edilebilen ödemelerinin indirimini gerektirdiğinden, hesaplama açısından diğer destekten yoksun kalma tazminatlarından ayrılmaktadır. Çalışmamızda iş kazası ve meslek hastalıklarının tanımı, destekten yoksun kalma tazminatına hak kazanılması için gerekli şartlar, destekten yoksun kalma zararının belirlenmesi ve bu zarardan hangi kalemlerin indirim konusu yapılacağı, destekten yoksun kalma tazminatının belirlenmesi ve tazminattan indirim kalemleri irdelenmiş, ardından hesaplama yöntemleri açıklanmaya çalışılmıştır.

Compensation for loss of support is an exceptional type of compensation in our law, which is regulated by the legislator under Article 53 of the Turkish Code of Obligations. Since the damage of loss of support is a loss that's going to occur in the future, its calculation involves many unknowns due to its nature and this situation brings different applications to the agenda. Compensation for loss of support due to work accident and occupational disease, which is the subject of our study, is distinguished from other compensations for loss of support in terms of calculation, as it requires the deduction of Social Security Institution's recourse payments. In our study, the definition of work accidents and occupational diseases, the necessary conditions for being entitled to compensation for loss of support, the determination of loss of support and which items will be deducted from this damage, the determination of compensation for loss of support and the items for deduction from compensation are examined and then, the calculation methods are tried to be explained.
