Özet
Bu çalışmada Talâk Sûresinde geçen ahkâm âyetleri incelenerek aile hukukunda boşanmayla ilgili konulara ışık tutması amaçlanmıştır. Boşamayla ilgili bazı meselelere açıklık getiren çalışmamız giriş, üç bölüm ve sonuçtan oluşmaktadır. Giriş kısmında araştırmamızın konusu, amacı, önemi ve yöntemi ve talâkla ilgili daha önce yapılmış olan çalışmaların incelenerek literatüre dair bilgiler verilmektedir. Çalışmamızın birinci bölümünde talâkın tanımı, meşrûiyyeti, boşanma ile ilgili çeşitli hükümlere değindik. İkinci bölümde talâkın şekli, zamanı sünnete uygun olup olmamasına ve geri dönüşü olup olmamasına göre talâk çeşitleri ile ilgili bilgi verilmektedir. Üçüncü bölümde iddetin tanımı, mâhiyeti, meşrûiyeti, çeşitleri ve iddet süreleri ile ilgili konuları inceledik. Dördüncü bölümde iddetin sonuçları, iddet bekleyen kadının mesken ve nafakası ile boşamadan sonraki zamanda çocuğun bakımı üzerinde durduk. Çalışmamızda talâk sûresinin tefsirlerde nasıl incelendiğine bakılarak, ahkâm tefsirlerinde konuyla ilgili zikredilen bilgileri fıkıh kitaplarından tekrar bir incelemeye tabi tutarak genelde dört fıkıh mezhebinin görüşlerini, delilleriyle ortaya koymaya çalışılmıştır.

It is possible to continue to shed light on the issues of divorce in family law by examining the verses of judgments in the Surah Al-Talâk. The introduction of our study, which intermittently addresses some events related to divorce, consists of three parts. The subject, purpose, importance and method of our research in the introduction section and literature information are provided by examining the Surah Al-Talâk and previously existing cases. In the first part of our study, we touched on the definition of divorce, its legitimacy, and various provisions regarding divorce. In the second part, the 1-3 of the Surah Al-Talâk. The form of divorce mentioned in the verses is in accordance with the Sunnah, delivery and return, and information is provided about the form of divorce delivered. In the third section, we examined the issues related to the definition, nature, legitimacy, types and iddah options of iddah. In the fourth section, we focused on the consequences of iddah, the residence and alimony of the woman waiting for iddah, and the care of the child after divorce. In our study, by looking at how the surah of talaq is examined in the interpretations, the relevant information mentioned in the interpretations of the rulings is subjected to a re-examination from the books of fiqh, and generally the collection of the four schools of fiqh and its evidence is presented.
