Özet
Kişilerin günlük hayatta her durum ve olaya ilişkin gerçek durumu bilmeleri mümkün olmadığından asıl hak sahibi olmayan kişilerle iş ve işlemler yapılabildiği görülmektedir. Kişilerin gerçek durumu yansıtmayan iş ve işlemleri hukuki görünüşe güvenerek gerçekleştirmeleri halinde bunların geçerli olmaları ise iyiniyeti koruyan istisnai hükümlerin varlığı ile mümkün olmaktadır. Buna göre bir kişi gerçek durumu bilmiyor ve bilmesi de gerekmiyor ise iyiniyetli kabul edilir. Ancak kişilerin bilgisizliği her durumda gerçek duruma aykırı bir sonucun korunması için yeterli olmamakta, yalnızca kanunda iyiniyetin korunacağına ilişkin bir hüküm bulunması halinde iyiniyetin korunması gündeme gelmektedir. Bu istisnai hükümlerin varlığı halinde her zaman aynı sonuçlar meydana gelmemekte, bazı durumlarda kişinin mevcut durumu bilmemesinden kaynaklı olarak meydana gelecek olumsuzluklardan tamamen korunması sağlanmakta iken bazen de hakkaniyet düşüncesiyle tazminata hükmedilebildiği görülmektedir. Özellikle ticari hayatın istikrarlı bir şekilde devam edebilmesi açısından iyiniyetli kişilerin korunması son derece önemli olup iyiniyet korumasının etkisini en çok eşya hukuku üzerinde gösterdiği söylenebilecektir. Bu nedenle çalışmamızın ilk bölümünde iyiniyet kavramı, unsurları, ispat edilebilmesi ve sonuçları gibi başlıklar altında incelendikten sonra ikinci bölümde iyiniyetin eşya hukukunda tam olarak ve üçüncü bölümde kısmi olarak korunmasına yönelik hukuki düzenlemeler ve bunların uygulamadaki yansımaları doktrindeki görüşler ve yargı kararları ışığında incelenmiştir.

Since it is not possible for people to know the real situation regarding every situation and event in daily life, it is seen that transactions may be carried out with persons who are not the real right holders. In the event that people carry out transactions that do not reflect the real situation by relying on the legal appearance, their validity is possible with the existence of exceptional provisions that protect good faith. Accordingly, if a person does not know the real situation and does not need to know it, he/she is considered to be in good faith. However, the ignorance of the people is not sufficient for the protection of a result contrary to the real situation in all cases, and the protection of good faith comes to the fore only if there is a provision in the law that protects good faith. In the presence of these exceptional provisions, the same results do not always occur, in some cases, it is ensured that the person is completely protected from the negativities that will occur due to the ignorance of the current situation, and sometimes it is seen that compensation may be awarded with the consideration of goodfaith. The protection of goodfaith is of utmost importance, especially for the stable continuation of commercial life, and it can be said that the protection of goodfaith is most effective in the law of property. For this reason, in the first part of our study, the concept of good faith, its elements, its proof and its consequences are examined under the headings such as, in the second part, the legal regulations for the full protection of good faith in the law of property and in the third part, the legal regulations for the partial protection of good faith and their implementation.
