Özet
Schopenhauer'in pratik felsefesi ile onun ontolojisi ve bilme yetisine ilişkin düşünceleri arasında bir bağlantı olduğu tespit edilmiş ve bu kapsamda dünyanın isteme yönü ile Schopenhauer'in hak, adalet, devlet ve ceza hukukuna ilişkin düşünceleri bu kapsamda ele alınmıştır. Schopenhauer, istemenin tüm varlıklarda aynı ve eşit derecede bulunduğunu, bir tek insanın soyut düşünme becerisi sayesinde bunun bilincine varabildiğini söylemiştir. Bu durum insana doğa tarafından verilen merhamet güdüsü sayesindedir. İnsan, herkesin benzeri acıları çektiğini görür ve onlara merhamet eder. Kendisinden önce onları düşünmeye başlar. Fakat bu, herkesin yapabileceği bir şey değildir. Bu sebeple de bir arada ve huzur içinde yaşayabilmek için insanlar bir araya gelerek bir sözleşme oluşturmuş ve devleti kurmuşlardır. Devlet, insanın doğuştan sahip olduğu hakların korunması için vardır. Devlet koruyuculuğunu yasalar ve cezalar vasıtası ile sağlar. Evrendeki birlik adalette ebedi adalet olarak karşımıza çıkar. Schopenhauer, herkesin bunu kavrayamayacağının bilincinde olduğundan bir de zamansal adalet olması gerektiğini vurgular. Devlet, zamansal adaletin tesisini sağlayıcı bir koruma kurumudur. It has been determined that there is a connection between Schopenhauer's practical philosophy, ontology and knowledge about the ability to know, and this ability is discussed in terms of the unwilling aspects of the world and Schopenhauer's ability regarding rights, justice, the state and the penal system. Schopenhauer said that the will is present in all beings at the same and equal level, and that only a person can become conscious of this thanks to the ability to think abstractly. This is due to the compassion instinct given by human nature. A person sees that everyone is suffering from similar pains and has compassion for them. They start thinking about them before themselves. However, this is not something that everyone can do. For this reason, in order to live together and in peace, people have come together and formed a contract and established the state. The state exists to protect the rights that people have. The state provides protection rules and means of punishment. The unity in the universe emerges as eternal justice in justice. Schopenhauer emphasizes that everyone is aware that they cannot grasp this and that there must also be temporal justice. The state is a protective institution that provides temporal justice. Our study explains the pattern of all these connectors with step-by-step reading.
