Özet
Günümüz dünyasında spor ve özellikle futbol insan yaşamında önemli bir yere sahiptir. Küçüğünden yaşlısına geniş kitlelerce sevilen ve takip edilen futbolun artan popülaritesi ortaya adeta bir endüstrinin çıkmasına neden olmuştur. Futbolun profesyonel bir spor dalı olması, beraberinde bu spor dalında faaliyet gösteren her paydaşın dahil olduğu hukuki ilişkiler özelinde daha dikkatli davranması gerekliliğini getirmiştir. Farklı birçok hukuki ilişkiyi bünyesinde barındıran bu spor dalında şüphesiz en çok ön plana çıkan ilişki, taraflarını profesyonel futbolcuların ve kulüplerin oluşturduğu profesyonel futbolcu sözleşmelerinden doğan iş ilişkileridir. Bu çalışmada, ülkemizin spor gündeminin merkezinde yer alan futbolun hukuk literatüründe kalbi olarak nitelendirebileceğimiz profesyonel futbolcular ile kulüpler arasında imzalanan profesyonel futbolcu sözleşmeleri her yönüyle ele alınmaya ve açıklanmaya çalışılmıştır. Çalışmamızda; Türkiye'de futbol faaliyetlerini yürütmek, düzenlemek ve denetlemekle yetkili olan en üst ve tek kurum olan Türkiye Futbol Federasyonu tarafından çıkartılan talimatlar özelinde, iç hukuk sınırları içerisinde, açıklamaya çalıştığımız profesyonel futbolcu sözleşmesinin unsurları tespit edilerek tanımına yer verilmiş, hukuki niteliği, şekli, süresi ve tarafları incelenmiştir. Tarafların sözleşmeden doğan hakları ve borçları, bu sözleşmenin baş aktörü olan profesyonel futbolcu perspektifinden ele alınarak incelenmiş, hangi hallerde bu sözleşmenin sona ereceği açıklanarak, sona erdikten sonra gündeme gelen hukuki meseleler üzerinde durulmuştur.

In today's world, sport, particularly football, occupies a significant place in human life. The increasing popularity of football, which is loved and followed by broad segments of society ranging from the young to the elderly, has effectively led to the emergence of an industry. The fact that football has become a professional branch of sport has, in turn, necessitated greater legal diligence with regard to the legal relationships involving all stakeholders operating within this field. Among the numerous legal relationships inherent in football, the most prominent undoubtedly consists of the employment relationships arising from professional football player contracts, the parties to which are professional football players and clubs. This study seeks to comprehensively examine and elucidate professional football player contracts concluded between professional football players and clubs, which may be regarded as the very heart of football within the legal literature and which occupy a central position in the sports agenda of Türkiye. Within the scope of the study, and within the boundaries of domestic law, particular emphasis is placed on the regulations issued by the Turkish Football Federation, the highest and sole authority competent to conduct, regulate, and supervise football activities in Türkiye. In this context, the essential elements of the professional football player contract are identified and its definition is provided, followed by an examination of its legal nature, form, duration, and parties. The rights and obligations arising from the contract are analyzed primarily from the perspective of the professional football player, who constitutes the principal actor of the contractual relationship. Furthermore, the circumstances under which the contract may be terminated are explained, and the legal issues that arise following the termination of the contract are discussed.
