Özet
Modernizm, insanların gelişmişlik düzeyi, hayat tarzı ve sosyal ilişkilerini etkilediği gibi kültürel alanın en önemli unsuru olan ilmî disiplinleri de derinden etkilemektedir. Bu kapsamda Batı'da reform hareketlerinin dinî anlayışın yeniden inşasına öncülük ettiği söylenebilir. Aynı süreç Doğu toplumlarında tecdid, ıslah ve öze dönüş gibi kavramların daha fazla işlenmesine zemin hazırlamıştır. Kültürel çalışmalar bağlamında farklı disiplinlerin felsefe ile anılmasının giderek yaygınlık kazanması da bu kapsamda değerlendirilebilir. Bu bağlamda din, hukuk ve tarih felsefesi gibi yeni disiplinlerden söz edilebilir. Ancak yeni tabirlerin kullanılmasına meşruiyet sağlayan klasik ve köklü tabirlerin varlığı bütünlük arz eden bir sürecin yansıması mahiyetindedir. Dolayısıyla 21. yüzyıla kadar İslâm hukuk felsefesi formundaki tâbirlere rastlanılmaması gelenekte aynı manayı yansıtan kavramların olmadığı anlamına gelmemektedir. Bu açıdan İslâm hukuk tarihinde makāsıd, gaye, illet ve hikmet gibi kavramlar söz konusudur. Günümüzde bu kavramların tamamını ifade etmek üzere İslâm hukuk felsefesi tâbiri yaygınlaşmıştır. Muhammed Mustafâvî Felsefetü'l-fıkh, Nazariyyâtü'l-hükmi ve'd-devle ve el-Usûlü'l âmme li-nizâmi't-teşrî' gibi eserlerinde söz konusu gerçekleri dikkate alarak süreci değişik açılardan kendine özgü bir yöntemle izah etmeye çalışmaktadır. Onun yönteminde ictihad ve fıkıh dilinin önemli bir yer işgal ettiği izahtan varestedir. Bu bağlamda makâsıd ve maslahat çerçevesinde fıkhın İslâm hukukuna, İslâm hukukunun İslâm hukuk felsefesine evrilmesi önemli dinamikler barındırmaktadır. Çalışmamızda söz konusu evrilme süreçleriyle Mustafavî'nin fıkıh usulüne dair modern yaklaşımlarına değinilecektir.

Modernism has been seen to deeply influence not only people's level of development, lifestyle, and social relations, but also the scientific disciplines, which are the most important elements of the cultural sphere. In this context, it can be said that reform movements in the West led the reconstruction of religious understanding. The same process prepared the ground for concepts such as renewal, reform, and a return to essence to be discussed more extensively in Eastern societies. In the context of cultural studies, the increasing tendency for different disciplines to be associated with philosophy can also be evaluated within this framework. In this regard, it is possible to speak of new disciplines such as the philosophy of religion, law, and history. However, the existence of classical and well-established terms that legitimize the use of new expressions reflects a process that maintains coherence and continuity. Therefore, the fact that expressions in the form of Islamic legal philosophy were not encountered until the 21st century does not mean that there were no concepts in the tradition reflecting the same meaning. In this respect, concepts such as maqāṣid, purpose, 'illa (effective cause), and wisdom have existed in the history of Islamic law. Today, the term“Islamic legal philosophy”has become widespread to express all of these concepts. In his works such as Felsefetü'l-fıkh, Nazariyyâtü'l-hükmi ve'd-devle and el-Usûlü'l âmme li-nizâmi't-teşrî', Muhammed Mustafāvī attempts to explain this process from different perspectives with a method unique to himself, taking these realities into account. It is evident that ijtihād and the language of fiqh occupy an important place in his method. In this context, the evolution of fiqh into Islamic law, and of Islamic law into Islamic legal philosophy within the framework of maqāṣid and maṣlaḥa, contains significant dynamics. In our study, these processes of evolution and Mustafāvī's modern approaches to the methodology of fiqh will be addressed.
