Özet
Ceza Kanunumuzun ikinci kitabında, özel hayattın gizli alanının korunmasına yönelik hükümler arasında, kişisel verilerin kaydedilmesi suçu tanzim edilmiştir. Kişisel verilerin korunması, günümüzde hem birey hak ve özgürlükleri hem de toplumsal düzen açısından büyük önem arz eden hukuki meselelerden birini oluşturur. Teknolojinin gelişmesiyle birlikte verilerin toplanması, işlenmesi ve saklanması kolaylaşmış; bu durum bireylerin özel hayatlarının ihlali riskini de beraberinde getirmiştir. Bu noktada kişisel verilerin kaydedilmesi suçu, bireyin mahremiyet alanını koruma altına alan temel ceza normlarından biri olarak karşımıza çıkmaktadır. Bu tez çalışmasında, kişisel verilerin kaydedilmesi suçu ceza hukuku perspektifinden ele alınmış, suçun unsurları, koruduğu hukuki değer, fail ve mağdur bakımından özellik arz eden yönleri detaylı olarak incelenmiştir. Ayrıca, kişisel veri kavramı, verinin hukuka aykırı şekilde kaydedilmesiyle doğan zararlar ve bu suçun diğer suç tipleriyle ilişkisi üzerinde durulmuştur. Çalışmada öğretideki görüşler, yargı ve kurul kararları ışığında kişisel verilere ilişkin genel bir açıklama yapılmış ve suç tipinin uygulama alanı değerlendirilmiştir. Tez kapsamında ayrıca, KVKK ile TCK arasındaki ilişki de değerlendirilmiş, idari ve cezai yaptırımlar arasındaki ayrım ortaya koyulmuştur. Bu çalışma hem veri koruma hukuku hem de ceza hukuku bakımından kişisel verilerin korunmasına yönelik cezai yaptırımların ne derece etkili olduğu sorusuna cevap aramayı amaçlamaktadır.

The offense of unlawfully recording personal data is regulated within the provisions aimed at protecting the confidential sphere of private life in the second book of our Penal Code, which governs crimes against individuals. The protection of personal data constitutes one of the most significant legal issues of our time, both in terms of individual rights and freedoms and with regard to the maintenance of social order. With the advancement of technology, the collection, processing, and storage of data have become increasingly easier, a development that has simultaneously heightened the risk of violations of individuals' private lives. In this context, the offense of unlawfully recording personal data emerges as one of the fundamental criminal law norms designed to safeguard an individual's sphere of privacy. In this thesis, the offense of unlawfully recording personal data is examined from the perspective of criminal law. The constituent elements of the offense, the legal interest it seeks to protect, and the aspects that present distinctive features with respect to the perpetrator and the victim are analyzed in detail. In addition, the concept of personal data, the harms arising from the unlawful recording of such data, and the relationship of this offense with other types of crimes are discussed. Within the framework of the study, a general explanation regarding personal data is provided in light of doctrinal opinions as well as judicial and board decisions, and the scope of application of the offense is evaluated. Furthermore, the thesis examines the relationship between the Personal Data Protection Law (KVKK) and the Turkish Penal Code, and clarifies the distinction between administrative and criminal sanctions. This study aims to answer the question of to what extent criminal sanctions aimed at the protection of personal data are effective, both from the perspective of data protection law and criminal law.
