Özet
öz 1989 Londra Kurtarma Konvansiyonu ile“No Cure No Pay”prensibine istisna getirilerek çevrenin korunmaya çalışılması amaçlanmış ve çevreye zarar gelme tehlikesinin bulunduğu hallerde kurtancıya“Special Compensation”adı altında bir ödemenin yapılacağı düzenlenmiştir. Special Compensation mekanizmasının umulan şekilde çalışmaması, tazminat hesabının karışık ve zaman kaybına yol açması ve de uyuşmazlığın çoğunlukla mahkemelere intikal etmesi sebebiyle uygulamada görülen sakıncalar“Scopic Klozu”olarak bilinen düzenleme ile giderilmek istenmiştir. Sabit ücret tarifelerinin yer aldığı Scopic klozu ile kurtarıcının ücretini en kısa zamanda alabilmesinin sağlanması istenmiş ve klozun geçerli hale gelebilmesi için çevreye zarar gelme tehlikesi de aranmamıştır. LOF standart kurtarma formları ile de çevre kirliliğinin önlenmesinin yanı sıra kurtarma faaliyetlerini basitleştirmek ve tarafların çok uluslu olmalarından kaynaklanabilecek olan hukuki uyuşmazlıkları en aza indirgemek istenmiştir. ABSTRACT The 1989 London Salvage Convention was intended to prevent damage to the environment by creating an exception to the“No Cure No Pay”principle. Therefore salvors are entitled to an award of“Special Compensation”if there is a threat to the environment. However, the special compensation mechanism did not work out as expected because determining the amount of special compensation was complex and time consuming and frequently involved litigation. Therefore, the concept of Special Compensation was replaced by the so-called“Scopic Clause”. By scopic clause it's intended that salvors should have their remuneration as soon as possible. Further, it's not depended on or in any way related to a threat of damage to the environment. In addition to prevent damage to the environment, the Lloyd's standard forms tried to sffl^Ufy the process by which salvage services were rendered, inter alia by reducing the legal issues relating to the international nature of the salvage operation.
