Özet

ÖZET Bu çalışmada, Askeri Ceza Kanununun 87 nci maddesinde düzenlenmiş bulunan emre itaatsizlikte ısrar suçunun, unsurlarının ve hukuki özelliklerinin değerlendirilmesine, bu konularda önem arz eden hususların Askeri Yargıtay kararlan ile birlikte açıklanmasına çalışılmıştır. Çalışmamız üç bölümden oluşmaktadır. Birinci bölümde, emre itaatsizlikte ısrar suçu ile ilgili olan terimler açıklanmış, emir konusu ile yakından ilgili olması nedeni ile emrin ifası ve sorumluluk meselesine değinildikten sonra da emre itaatsizlik etmek hususuyla ilgili olarak tarihsel süreç içeri sinde çeşitli dönemlerde gerçekleştirilen uygulamalar değerlendirilmiştir. İkinci bölümde ise, emre itaatsizlikte ısrar suçunun suç teorisi bakımından izahı konusuna yer verilmiştir. Öncelikle aralarındaki yakın ilişki dolayısıyla suçun koruduğu hukuki değer ve mağduru konusuna değinilmiş, suçun, faili açısından mevcut bulunan özellikleri açıklandıktan sonra da unsurları dışında kalan hususlar ve suçun unsurları emsal Askeri Yargıtay kararlan ile izah edilmiştir. Çalışmamızın son bölümünde de, emre itaatsizlikte ısrar suçunun yapısal özellikleri ele alındıktan sonra sırasıyla suçun özel görünüş biçimleri, suçu etkileyen nedenler, özellik arz etmesi nedeni ile emre itaatsizlikte ısrar suçunun askeri suçlar arasındaki yeri, bu suçla ilgili olarak vücut bulduğu maddedeki ve ağırlaştırılmış hallerinin düzenlendiği maddelerdeki yaptırımlar ile zamanaşımı meselesi ve kovuşturma konulan sunulmaya çalışılmıştır.

ABSTRACT In this study, the juridical properties and the elements of the offense of insist on the disobedience to the order which has been organized in the regulation no 87 in Military Criminal Code are tried to be utilized and explained with the Military Supreme Court decisions. Our study consists of three chapters. In the first chapter, the terms which are related to the offense of insist on the disobedience to the order are explained and the applications which are realized in the different periods in the historical process are utilized in connection with the disobedience to the order after touching on the matter of the performing of the order and responsibility. In the second chapter, the offense of insist on the disobedience to the order is illustrated in the view of the offense theory. Firstly, the subjects of legal merit and dupe of the offense of insist on the disobedience to the order are touched on. After the properties of the offense of insist on the disobedience to the order are explained from the maker of the offense of insist on the disobedience to the order of view, the elements of the offense of insist on the disobedience to the order and the matters which are out of the elements of the offense of insist on the disobedience to the order are illustrated in the view of the Military Supreme Court decisions. In the last chapter of our study, after we take the structural properties of the offense of insist on the disobedience to the order up, the special appearance forms of the offense of insist on the disobedience to the order, the reasons which effect the offense of insist on the disobedience to the order, the place of the offense of insist on the disobedience to the order in the military offfenses, the sanction of the offense of insist on the disobedience to the order, the matters of the prescription and prosecution are tried to be presented.
