GENERAL KNOWLEDGE Name and Surname Ekrem Kurt Field Law Program Private Law Supervisor Professor Dr. Cevdet Yavuz Degree Doctorate Keywords Rectification of Land Register ABSTRACT RECTIFICATION OF LAND REGISTER The rectification of the land register is one of the difficult fields of the Turkish Civil Law. In this dissertation it was held and studied. The land registry is a public record which is produced and kept by the special officer who is called as the“registrar (of land register)”. These are the public documents that creates a presumption on the existence of the rights shown there. Those records are open to the public and anyone who is interested in the register can see it and ask copies. Any right on an immovable exists without being registered, or is incorrectly registered or incorrectly cancelled or if any caution or objection that has a function and affect similar to the entries in the land registry, that should have been cancelled has not been cancelled, the person affected by the incorrect state of the register may apply for a rectification of the register, and may compel any person whose rights would be affected by the incorrect state of the register may apply for a rectification of the register, and may compel any person whose rights would be affected by such rectification to give his assent thereto, and to procure any registration required for the purpose of making such assent effective. This dissertation as a whole, consists of two main chapters. In the first chapter, the basic principal of entry İn the land register in Turkish Civil Law, its exceptions provided by the Turkish Civil Code and the other codes and the reasons which cause wrong entries were exposed. The entry which never contains the correct real right situation is called as a“wrong entry”(injustice entry). It should soon be rectificated because it is necessary for both individual and the public interest. In the second chapter, rectification solutions were classified. First of all the secondary ways for the rectification of the register are in three different solutions that are provided in the Art. 1026 and 1027 of The Turkish Civil Code and as an exceptional way in the Art. 41 of The Cadastre Act. IllIn the final part of the second chapter major rectification way (Turkish Civil Code Art. 1025) was in detail discussed and explained. It is both theoretically and practically most important and widely applied solution for the purpose of rectification in the land register. It directly affects the real right on an immovable property. The rectification through a jurisdiction is the most popular way in Turkish legal practice. The other rectification ways are used in limited frequency in the legal practice. This practice cause more work and effort in the courts. IV
