ABSTRACT An employee who has work accident, can get compensation of monetary loss from who, can require under which conditions and how this compensation which is arised from work accident, is calculated, are forming theme of this thesis.“Sosyal Sigortalar Kurumu”(Social Insurance Association) which is a kind of Turkish social guarantee association, is compensating some part of monetary loss that employee encountered because of the work accident. Employee has got right of bringing a lawsuit against to his employer for the compensation of his loss which is not compensated by the social guarantee association if there are evident conditions. But for this, there must be a reason-result relation between monetary loss and the work which is executed by employer and between monetary loss and accident. Seperately there musn't be an interruption in this relation. While judged monetary compensation is calculated, some criterions and hypothesis' are used in this kind of lawsuit that brought against to employer. While the compensation is calculated, firstly, age of employee at the moment of accident, his salary, faults of the sides in the accident, his out of service case rate and his out of service case is continual or not, are determined; then employee's work and old age periods and his probable salaries in future are calculated as hypothetical and lastly employee's total loss which is arising 203from accident, is calculated by using the evident calculation methods and available datas. This loss which is calculated, is reduced according to employee's faults and his service out rates. Benefits which are got because of the work accident, (such as financial value of the aids that made by the social guarantee association) are reduced from the loss and so, employee's loss which is not compensated by the social guarantee association is calculated and it is passed sentence on as monetary compensation that arised from work accident. 204
