IV ÖZET Klasik Dönem Osmanlı Toplumunda Suç Bağlanımda Osmanlı Sosyal Tarihinin Lise Ders Kitaplarında İncelenmesi Öznur MENNAN Osmanlı Devleti'nde suçu incelemek, Osmanlı toplumunu anlamak adına önemlidir. Tarihsel açıdan suçun incelenmesi günümüzdeki tarihçiliğin ilgi odağı olan sosyal tarihin kapsamına girmektedir. Türkiye'de Osmanlı tarihi incelemelerinde sosyal tarih alanında henüz uluslar arası standartlarda araştırma örnekleri verilmemiştir. Osmanlı toplumunu anlamak için önemli bir konu olan suç konusunda ise hiçbir akademik çalışma yapılmamıştır. Bunun yanında tarih öğretimindeki sorunlar üzerinde çalışan araştırmacılar tarih ders kitaplarının siyasal tarih ağırlıklı anlatışım eleştirmekte ve tarih ders kitaplarında sosyal tarihe yer verilmesi gerektiğini vurgulamaktadırlar. İncelediğimiz lise ders kitaplarındaki Osmanlı toplumu anlatısı, Osmanlı toplumunu idealleştirme ya da aşırı yerme eğilimlerine neden olmaktadır. Osmanlı toplumuna ilişkin bu yanılgıların aşılabilmesi, sosyal tarihin ders kitaplarında daha geniş boyutta ele alınması ile mümkün olacaktır. Tarih ders kitaplarında sosyal tarihe yer verilebilmesi için onlara kaynaklık edebilecek akademik düzeyde Osmanlı sosyal tarih çalışmalarının yapılmış olması gerekmektedir. Osmanlı Devleti'nde suçu araştırırken birincil kaynak olarak Afyon seriye sicillerini kullandık. Bu araştırma kapsamında, mahkeme kayıtlarında yer alan ve sadece kişiler arasında oluşmuş suç kayıtlarım inceledik. Kayıtlardan yola çıkarak suçları; mülkiyete saldırı suçları, şahıslara karşı işlenen suçlar, cinsel suçlar, yasaklanmış maddelere ilişkin suçlar şeklinde bölümlere ayırarak inceledik. İslam hukuku ve örfi hukuk kurallarına göre Osmanlı İmparatorluğu' nda bu suçları işleyenlere nasıl yaptırım uygulandığım tespit etmeye çalıştık. İslam hukukunun öngördüğü yaptırımlar için Çatalcalı Ali Efendi'nin Feteva-yı Ali Efendi adlı çalışmasından, örfi hukuk için de kanunnamelerden yararlandık. Suç konusunda yaptığımız araştırma neticesinde, Osmanlı Devleti'nde ne tür suçların görüldüğünü, kimlerin mahkemeye şikayette bulunduklarım ve İslam hukuku ve örfi hukukunun bu suçlara öngördüğü cezaları, ceza konusunda İslam hukuku ile örfi hukukunun benzeştiği ve ayrıldığı noktalan tespit etmeye çalıştık. Şikayet konusu olan bu suçları hazırlayan etmenlerin, Osmanlı Devleti'nde yaşanan sosyo-ekonomik değişiminin toplumsal bir yansıması olduğu sonucuna vardık. ABSTRACT The Study of the Ottoman Social History in the sense of Crime in the Classical Age of Ottoman Society in High School Text Books Öznur MENNAN To study the crime in Ottoman State is important in the name of understanding the Ottoman society. The study of crime in terms of history is included in social history which is an interest focus of current historiography. In Turkey, in the study of Ottoman history, in the field of social history, no research examples in international standarts have been given yet. To understand the Ottoman society, no academic research has been done about crime which is an important subject. On the other hand, the researches studying on the problems in history teaching criticize the narration largely about political history of history text books and they also emphasize that social history should be placed in history text books. The Ottoman society narration in the high school text books that we analyzed causes the intention of idealizing of the Ottoman society or excessive criticising. To overcome these errors related to the Ottoman society in text books will be possible by dealing with the social history in the text books in a comprehensive way. To be able to include the social history in history text books, it is necessary for the academical Ottoman social history studies that will form the base for them to have been made. We used Afyon Muslim Court Archieves as the primary source while searching for the crime in Ottoman State. In the course of this research, we analyzed the crime records included in the court records and occured only between people. Considering the records, we analyzed the crimes by divinding them into parts such as; crimes of ownership attacks, crimes commited against individuals, sexual crimes and crimes related to the forbidden substances. According to the principles of Islam law and customary law, we tried to determine how the Ottoman State imposed sanctions on those that commited the crimes. For the sanctions foreseen by Islam law, we benefited from Çatalcalı Ali Efendi' s work named as Fetava-yı Ali Efendi and for the customary law from kanunnameler. In the consequence of the research we made about the crime, we tried the determine what kind of crimes occured, who complained to the court, the punishment that Islam and customary laws envisaged for these crimes, and the points that Islam and customary laws resemble each other and seperate from one another. We came to the conclusion that the factors bringing about these crimes under complaint are the social reflection of social- economic change occured in Ottoman State.
