ABSTRACT Today, studies of realizing human rights and entering the European Union are accelerated; contributions of every institution and individual are needed. In the Preliminary investigation stage which is an indispensable part of Criminal Procedure Law, judicial security force officials' role is large. Hence, our thesis consists of three chapters. In first chapter, subjects of reasons of conviction as obstruction of individual liberty and behaviour patterns contrary to human rights in the cases of the ECHR, and judgement of the ECHR on human rights in relation to Turkey are handled generally and general information about positive criminalistics, method of finding the suspect from evidence, are given. On this frame, subjects of positive criminalistics concept, its history, subject, goal, functions and comparing similar disciplines are discussed. In second chapter, matters of obtaining of positive criminological data, inspection approaches and evaluation of them, classification and evaluation of crime scene findings are discussed in detail. For this account, subjects of the place of security force in positive criminalistics, evidences that are obtained by it, and evaluation of evidences are examined in last chapter. Duties of expert security force, necessity of its establishment, and studies relating to draft bills are examined briefly. Laboratory works within preliminary investigations and in evaluation of incident are examined in turn. Our aim is to specify the works in preliminary investigation in order that justice is realized quickly and effectively. When we do it, works of criminal police, as a unit that does works of judicial inquiry within security force duty, and works of judicial security forces are evaluated in the light of studies of the ECHR. In the process of research, information and documents which belongs to Public Order, Identification, Crime Scene Investigation, Departments, Criminal Police Laboratory Office and District Laboratory, are made use of.
