Özet
5237 sayılı Türk Ceza Kanununun İkinci Kitabın Dördüncü Kısmının Birinci bölümünde ?Kamu İdaresinin Güvenilirliğine ve İşleyişine Karşı Suçlar? başlığı altında Zimmet Suçu düzenlenmiştir. Koruduğu hukuki değerin kamu güveni olması, bu nedenle tüm toplumu ilgilendiren bir suç tipi olması ve bu suçu işleyebilecek kişilerin sadece kamu görevlileri olması nedeniyle zimmet suçu ceza hukukunda büyük önem arz eder.İki bölümden oluşan çalışmamızın ?Genel Bilgiler? başlıklı 1.bölümünde ?Kamu görevlisi, kamusal faaliyet, Kamu İdaresi, kamu hizmeti ve kamu görevi kavramlarından ceza hukuku bağlamında ne anlaşılması gerektiği üzerinde durulmuştur. Çalışmamızın esas sütununu oluşturan ?Türk Ceza Kanununda Zimmet Suçu? başlıklı 2.bölümünde ise 5237 sayılı Türk Ceza Kanununun sistematiğine uyularak suç tipi derinlemesine incelenmiş ve konu hakkında spesifik örnekler verilmek suretiyle, alternatif görüşler sunulmaya çalışılmıştır. Ayrıca doktrinde daha önce değinilmeyen zimmet suçunun bilişim yoluyla işlenmesine de bu çalışmada yer verilmiştir.

The crime of embezzlement has been regulated under the title of ?Offences Against The Reliability and Functioning of the Public Administration? in the first part of the fourth chapter of the second book of the Turkish Penal Code No 5237. The crime of embezzlement is of great importance in criminal law due to the fact that the legal value protected by the law is public trust and for this reason, it is a type of crime which concerns the whole society, and the individuals who might commit the crime in question are only public officials.Our study is composed of two parts. In the first part of our study, which is entitled ?General Information?, it is emphasized what is to be understood by the terms ?public official, public service, Public Administration, public utility and public duty? within the context of criminal law. In the second part of our study, which is entitled ?The Crime of Embezzlement in the Turkish Penal Code? and which constitutes the main pillar of our work, the crime type is thoroughly examined in accordance with the systematics of the Turkish Penal Code No 5237 and it is endeavored to present the alternative opinions by providing specific examples regarding the topic. Furthermore, the commission of the crime of embezzlement through informatics, which has not been mentioned in the doctrine before, is also given a place in the present study.
