Özet
05.12.1951 yılında yürürlüğe giren 5846 sayılı Fikir ve Sanat Eserleri Kanunu kapsamında eser sahiplerine, bu kanun çerçevesinde meydana getirdikleri eserlerinin korunması için geniş haklar tanınmıştır. İlerleyen yıllarda gelişen teknoloji ve değişen dünya görüşü çerçevesinde, kanunda çeşitli değişiklikler ve eklemeler yapılmış, bazı maddeler iptal edilmiştir.Yasada düzenlenen eser sahipliği konusunda günümüze kadar çok sayıda çalışma yapılmış olup kanunun 9. ve 10. maddesinde düzenlenen birlikte eser sahipliği türleri ayrı bir inceleme konusu yapılmadığı için bu çalışmada bu konu incelenmiştir. Bu çalışma ile, birlikte eser sahipliğinin tanımı yapılmış, özellikleri ayrı ayrı incelenmiştir. Birlikte eser sahiplerinin yasa gereği sahip oldukları haklar kısaca açıklanarak bu hakların eser sahipleri tarafından nasıl kullanılacağı uygulamada karşılaşılabilecek olasılıklar nazara alınarak ifade edilmiştir. Devamında bu haklara tanınan koruma süreleri ile hakların ihlali halinde başvurulabilecek hukuki ve cezai yollar müşterek ve iştirak halinde eser sahipliği türlerine göre ayrı ayrı izah edilmiştir.

Comprehensive rights have been bestowed on the authors as per the Law on Intellectual and Artistic Works numbered 5846 enforced on 05.12.1951 for protection of the works they have produced in compliance with this law. In the years, various amendments and additions have been made to the law in line with the developing technology and changing worldview, some articles have been abrogated.Many studies have been performed about the authorship regulated under the law up to present and the subject has been dealt with in this study as the types of collaborative authorship regulated under the articles 9 and 10 of the law have not been examined in a different study. Authorship has been defined and its features have been examined respectively in this study. The rights held by the collaborative authors as per the law have been explained briefly and the procedure for execution of these rights by the authors has been specified in consideration of the possibilities to be encountered in practice. In the following sections, the protection periods granted for these rights and the legal and criminal proceedings to be initiated upon violation of the rights have been explained respectively based on the types of collaborative and collective authorship.
