Özet
Bu tez öncelikle Klasik Liberalizmin kurucusu sayılan John Locke'un toplum sözleşmesi kuramı olmak üzere, diğer toplum sözleşmesi kuramcılarından Thomas Hobbes ve Jean Jaques Rousseau'nun toplum sözleşmesi kuramı ve John Locke'un siyasi fikirlerinin anayasacılığın gelişimi üzerindeki etkisini incelemeyi amaçlamaktadır. Toplum sözleşmesi kuramları, bilimsel gerçekliği karşılamamakla birlikte farazi olarak“Devlet”olgusunun ortaya çıkışını teorik çerçevede ele alan kuramlardır. Her üç filozof, devlet denen siyasal toplumun ortaya çıkışını, siyasal bir kurumlaşma öncesi anlamına gelen“doğa durumu”tasviri ile ele almışlardır. Doğa durumu, Thomas Hobbes için“insan insanın kurdudur”yaklaşımının esas alındığı savaş durumunu simgelerken, Rousseau bu durumu bilimsel gelişmelerden uzak,“akıl”dan çok "merhamef'in ağır bastığı ve insanların eşit bir şekilde yaşadığı bir ortam olarak tasvir etmiştir. Rousseau'ya göre insanlar arasındaki eşitsizlik tarımın ve uygarlaşmanın başlaması ile bozulmuştur. Ünlü filozof John Locke ise doğa durumu ile ilgili insanların özgür ve eşit olduğu bir resim çizer. Filozoflar, doğa durumu betimlemelerinden sonra, insanların bir araya gelerek sözleşme yolu ile oluşturdukları devlet olgusuna ulaşırlar. Devlet, Hobbes için dokunulmaz, aşkın bir misyon üstlenir. Rousseau, halkın iradesinin yansıdığı bir devlet modeli öngörürken, Locke ise bireylerin doğa durumunda sahip olduğu hayat, hürriyet ve mülkiyet haklarının koruyucusu olan bir devlet prototipi çizer.Tez çalışması ikinci olarak, filozof John Locke'un anayasacılık fikrinin gelişimine katkısını ele almaktadır. Anayasacılık, sınırlı devleti ve insan hak ve özgürlüklerinin korunmasını esas alan bir yaklaşım olmakla birlikte gelişimini ilk olarak Locke'un ortaya attığı kuvvetler ayrılığı kuramına ve onun bireye verdiği öneme borçludur.

This thesis primarily aims at analyzing not only the social contract -theory of John Locke, who is considered as the founder of Classical Liberalism, but also the social contract theory of Thomas Hobbes and Jean Jacque Rousseau, who are the other social contract theoreticians, and the effect of John Locke's political ideas on the development of constitutionalism. Social contract theories deal vvith the existence of the phenomenon of“State”in a theoretical and hypothetical vvay, but not by meeting the needs of scientific truth. Those three philosophers dealt vvith the emergence of the political society vvhich is called as state vvith the description of state of nature vvhich refers to the background of political institutionalization. While state of nature symbolizes vvarfare vvhich Thomas Hobbes assimilates it to the metaphor of“man is a vvolf to man”(Lt. homo homini lupus), Rousseau describes it as the environment in vvhich human beings live equally avvay from the scientific developments and“affection”plays an important role more that“vvise”does. To Rousseau, the equality among human beings collapsed at the outbreak of agriculture and civilization. Famous philosopher John Locke dravvs a picture about the state of nature on vvhich people are free and equal. After describing the state of nature, philosophers mention that people reach the phenomenon of the state that they founded by means of contract. To Hobbes, state assumes an inviolable and excessive mission. While Rousseau anticipates a state model in vvhich exists, Locke dravvs a protötypical picture of state vvhich is the protector of individuals' rights of life, freedom and property in the state of nature.The thesis secondly deals vvith the contribution of the philosopher Locke on the development of the idea of constitutionalism. Constitutionalism is an approach vvhich is based on limited state and the protection of human rights and freedom vvhile it ovves its development primarily to theory of division of povvers vvhich vvas pointed out primarily by Locke and his regarding individuals remarkably.
