Özet
Hukuk kendi öznelerini yaratırken bu özneleri ortak yaşam içerisinde etkin biçimde eylemde bulunma ve haklara sahip olma kapasitesinin birer aracı olarak kurgulamaktadır. Bu süreç ise, salt biyolojik bir anlama sahip olan yalın hayat ile toplumsal, siyasal ve hukuki varoluş biçimleri arasında bir ayrıma gidilmesi sonucunu yarattığından biyoiktidar ilişkisi çerçevesinde ele alınabilecek durumdadır. Mevcut çalışma, hukukun öznelerinin kurgulanma sürecinin biyoiktidar nosyonu çerçevesinde nereye düştüğünü incelemektedir.

Law creates its own subjects as fictionalized devices for having the capacity of ecting efficiently in common live and obtaining rights. This process is able to be handled with the perspective of biopolitics for it makes a distinction between the pure biological bare life and the existence forms arising in the realm of social, political and legal life. This study examines the meaning and position of legal subject?s fictionalization process in the frame work of the Notion of biopolitics.
