A thesis presented on wiretapping, which is a major debate issue between civil rights groups and law enforcement agencies. First, the history and the legal perspective of wiretapping in U.S. and rurkey were introduced. Second, a questionnaire was designed focusing on the most discussed issues on wiretapping and the questionnaires were delivered to both civilians and policemen from U.S. and Turkey. The survey revealed important flndings on this matter. Turkish policemen and civilians answered more supportively about using wiretapping on various crimes. All groups supported using wiretapping to fight against terrorism whereas gambling had the least support. Turkish policemen did not think that law enforcement agencies requested wiretapping installation only after having applied the exhaustion principle and American policemen did not believe that wiretapping can be and has been used by those in power to undermine the democratic process. Only Turkish policemen strongly believed that wiretapping is a way to prevent crimes. Both police groups disagreed that wiretapping should be applied after a crime has occurred. Findings show that privacy and freedom of communications are the central issues to the wiretap debate. Wiretapping is an inevitable and powerful tool for law enforcement agencies, but laws should strictly protect citizens' privacy from risks of abuse of this power.
