2010 Referendum for Constitutional Amendments made important changes to the Constitutional Court of Turkey (CCT) recognized with its state-centric rulings and as the most important institution of militant democracy in Turkey. The amendments included changes inter alia in the way of appointing members to the CCT and the introduction of individual access (constitutional complaint) to the CCT. It is stressed in the reasoning of new provision that it would provide a new protection avenue for human rights with the adoption of standards of the European Court of Human Rights (ECtHR) at domestic level thereby helping avoid taking the cases before the ECtHR. Scholarly interest in the constitutional complaint in Turkey is focused mostly on normative/procedural investigation into legal provisions within a comparative framework. Even though such a positivist/formal approach is noteworthy, it is thought that a critical examination in the light of comparative practices, emphasizing the historical roots and the place of the CCT in political life will shed light on possible legal, political and social changes the constitutional complaint may create. At that point, it is believed in this inquiry that the marginalized or alienated individuals or communities would have a right to challenge the exclusionary raison d'état in Turkey thanks to this mechanism so that the inclusion of the other in decision-making process may be assured.
