The headscarf is a much-debated issue across the world, but it is particularly the demands by women to wear it in public institutions that have provoked stormy controversies in Turkey. Without a constitutional ban, numerous students have been excluded from universities and many women have not been allowed to work as public officers. These violations – of freedom of religion, right to education and right to work – have been justified on the grounds of gender equality and secularism which have not been fully explained and based on interpretations by the army and politicians. This study finds that the justifications of Turkey are unfair, stereotypical and fictional in headscarf cases. While religion and secularism can be reconciled, Turkey has insisted on prioritising secularism rather than human rights. The stubborn and prejudiced position of Turkey and the fear of the European Court of Human Rights have led to violations of the rights and freedoms of women. The European Court of Human Rights has ignored the fact that the headscarf debate in Turkey does not hinge on legal arguments, it relies merely on established fears, anxieties and assumptions.
