Özet
Çalışmamızda, 5237 sayılı Türk Ceza Kanununun 109 ve devamı maddelerinde yer alan, kişiyi hürriyetinden yoksun kılma suçu incelenmiştir. Bu çalışmamamızın amacı; kişiyi hürriyetinden yoksun kılma suçunun tüm yönleri ile ele alınıp incelenmesi, uygulamaya ve doktrine katkı sağlayacak sonuçlara varılabilmesidir. Çalışmamız giriş ve sonuç kısımları hariç olmak üzere, iki bölümde ele alınmıştır. İlk bölümde; çalışmamızın temel kavramı olan 'hürriyet' ve kişiyi hürriyetinden yoksun kılma suçunun tarihçesi incelenmiştir. İkinci bölümde ise; kişiyi hürriyetinden yoksun kılma suçunun maddi, manevi ve hukuka aykırılık unsurları, suçun özel görünüş şekilleri ve sonrasında yaptırım ve kovuşturma usulü incelenerek çalışmamız tamamlanmıştır.

This study reviews the crime of deprivation of liberty which falls into the jurisdiction of the Article 109 (and continuing articles) in the Turkish Criminal Law No.5237. The aim of this study is to analyse the crime of deprivation of liberty thoroughly and to come to a conclusion which may contribute in the practice and the doctrine. The study consists of two parts excluding the introduction and conclusion parts. The first part reviews liberty, the basic concept of the study and analyses the history of the crime of deprivation of liberty. The second part includes the elements of the said crime regarding material, ideal and contrariety to law aspects, the special appearance of the crime as well as sanction and prosecution methods.
