Özet
Genellikle devletlerin idaresinde yetkinin bizzat yetkili makamlar tarafından kullanılması esastır. Ancak yetkinin her zaman bizzat yetkili makamlar tarafından kullanımı idarenin düzenli işleyişi ve kamu hizmetinin etkin biçimde sunumu açısından bazı sakıncalar doğurabilir. Bu sakıncaları ortadan kaldırmak adına yetkinin mevzuatla öngörülmüş asli sahibi olan kamu görevlisi yerine aynı idari düzen içindeki alt konumda yer alan bir başka kamu görevlisi tarafından kullanılmasına imkan veren bir müessese olarak yetki devri karşımıza çıkmaktadır. Bu çerçevede yetki devri kamu idaresinin işleyişine getirdiği kolaylıklar da dikkate alınarak çağdaş bir idare hukuku kurumu olarak kabul edilmektedir. Çalışmamızda yetki devrini çeşitli yönleriyle ve özellikle konuyla ilgili güncel Danıştay kararlarıyla daha yakından incelemeye çalışılmıştır.

Generally the exercise of power through the hands of the competent authorities in the administration of the States is essential. However, the exercise of power just through the hands of the competent authorities themselves may cause some major drawbacks in terms of the systematic order of the executive action and the efficient performance of the public services. In this respect, the concept of“delegation of power”comes forward as the usage of the authority by another public officer who holds hierarchically inferior position in the same administrative function instead of the principal athorized person. Therefore,“the delegation of power is widely accepted as a modern concept of the discipline of the administrative law taking into consideration that it provides great conveniences and comfort during the systemic operation of the public authorities. This thesis seeks to evaluate the concept of the ”delegation of power" and tries to analyse its components and features especially taking into account of judicial decisions of the Council of State.
