Özet
Devletlerin yönetim biçimlerini, halkla ve ilişkilerini düzenleyen kurallar bütününe hukuk kuralları denir. Devletler, tarihsel dönüşümlerle ve sosyolojik etkenlerle birlikte çağa ayak uydurabilmek için bazı yenilikler yaparlar. Çalışma kapsamında incelenen Osmanlı Devleti'nin yönetim biçimi, ekonomisi, askeri yapısı çağın değişimlerine ayak uyduramamıştır. Bu açmazdan kurtulmak için Osmanlı Devleti bir takım reform hareketlerine girişmiştir. Bu reform hareketlerinden birisi de Türkiye Cumhuriyeti hukukuna da temellerini oluşturan Hukuk alanında yapılan reformlardır. Ancak Avrupadaki reformlar başarıya ulaşırken; Osmanlı'da istenen başarı elde edilememiştir. Osmanlı Devlet'i, hukuk alanında yaptığı reformlarda da büyük zorluklarla karşılaşmıştır. Bu reformların yapılmasında rol oynayan devlet adamları, yapılan düzenlemeler ile Osmanlı'nın eski ihtişamına ulaşmasının mümkün olacağını düşünüyorlardı. Fakat uygulanmaya çalışılan reformlar ile halk ve kültür üzerindeki etkilerinin beklenen seviyede olmaması reformların başarılı olmasını engellemiştir. Bu çalışmada temel olarak Osmanlı hukukunda yaşanan Batılılaşma hareketlerinin tarihsel süreçleri, Osmanlı'nın yönetim yapısı, kurumları, gerçekleştirilen reformlar sonucunda devletin yaşadığı zorluklar ile toplumsal çöküntüler ve sebepleri açıklanmıştır.

The whole rules which regulates the states form of government and public relations are called the law. States make some innovations in order to keep abreast with the historical transformation and sociological factors. The Ottoman State's form of government, the economy and the military structure which are examined in this study could not keep pace with the changes of the age. As a result, the Ottoman State initiated a number of reforms to escape this impasse. One of these reform movements is reforms in law which form the basis of the law of the Republic of Turkey. However, when reforms in Europe were reaching success; it couldn't obtained desired success in the Ottoman State. The Ottoman State encountered big hardships in the reforms made in legal field. Person of government involved in carrying out these reform thougt that it would be possible to reach the former glory of the Ottoman State with making arrangements. But the reforms in that period couldn't made the suitable impact on public and so they prevented the success in expected level. In this study, it is basically described the historical process of westernization movement occurred in the Ottoman law, The management structure and the intitutions of the Ottoman State, the difficulties that government faced as a result of reforms and social breakdown with reasons.
