Özet
İslamî ilimler alanında önemli eserlerin verildiği Irak coğrafyası maalesef hak ettiği ilgiyi görmemiştir. Yörenin âlimleri ve eserleri ilim dünyasına tanıtılmamış birçok önemli eser, el yazma olarak raflarda beklemektedir. Bu önemli âlimlerden biri de Irak᾽ın Kürdistan bölgesinde doğan ve fıkıh alanında etkin olan Molla Nebi el-Mâvelî'dir. Toplamda iki eseri bulunan el-Mavelî᾽in“Menba'u'l-a'mal fî ma'rifeti mebâhisi't-taklîd ve tashîhi'l-ef'âl ve'l-akvâl”isimli çalışması, İslâm fıkhında yazılmış bir eserdir. Söz konusu eser küçük bir hacme sahip olup, İmam en-Nesefî᾽nin“Tuhfe”adlı eserine hâşiye olarak yazılmış, eserdeki kapalı ifadeleri açıklığa kavuşturmuş, belirsizlik taşıyan ifadelerin üzerindeki perdeyi aralamıştır. Bu çalışmada ilim dünyasının istifadesine sunulması gayesiyle bahse konu eser tahkik edilerek, mahtutât dünyasından matbuat dünyasına aktarılmıştır. Eserin tahkikinde, elimizde bulunan tek nüshanın metni incelenmiş, alanla ilgili kaynaklardan hareketle metinde geçen hadislerin ve diğer eserlerin tahrici yapılmıştır. Ayrıca eserde yer alan görüş ve metinler güvenirlilik açısından garip kelimeler ve metinde yer alan bilinmeyen isimlerin biyografisi verilmiştir. Giriş, iki bölüm ve sonuçtan oluşan çalışmanın birinci bölümünde Molla Nebî el-Malevî'nin hayatı ve yaşadığı dönem siyasî ve kültürel açısından ele alınmıştır. İkinci bölümde eserin metodu içeriği ve kaynakları hakkında bilgi verilmiş ve eserin tahkikli metni verilmiştir. Çalışma sonucu elde edilen bulgular, sonuç kısmında maddeler halinde sunulmuştur.

Praise be to God who made us the best nation among the nations. Peace and blessings be upon those whom God sent to the mercy of the worlds and on his family and his companions and followers to the Day of Judgment. Later on: (The source of the work in the knowledge of the practice of imitation and correct the acts and words) a small manuscript in it: Useful words, beautiful references and elegant comments on the tradition of Sheikh Mullah Nabi Al Mawaili. It is a small book but has a great benefit which has been written by the author (God's mercy may upon him) a footnote to the masterpiece, where he showed the contents of the Metn separated and removed it from the obscure things. I have achieved this manuscript and draw it out of the manuscript space to the world of publications for the benefit of lovers of science and knowledge. The work I have done in this manuscript is: to serve the text according to the method used in the investigation, depending on the only version available to me and interpreting the noble Prophet's Hadiths and the effects contained in the text and documenting the texts and sayings found in the book by reference to the sources considered in that field and the statement of strange words that the reader needs to return to the language books and dictionaries and translation of the unknown scholars and so on. I followed the investigation according to a curriculum and a plan consisting of: introduction and two chapters: First Chapter: Definition of Mullah Nabi Mawaili and his era. Second Chapter: The achievement of the text. Then I followed that by writing the conclusion and then the scientific indexes. I ask God to grant me success in this work and to make this work a matter of benefit and acceptance. God is capable of all things. And the last call to us is that Praise be to Allah, Lord of the Worlds, and may Allah bless our Prophet Muhammad and his family and his companions and followers.
