Özet
Tezin amacı;“Seçim Sistemlerinin Yönetimde İstikrar ve Temsilde Adalet Üzerinde Belirleyiciliği Var mı?”sorusunun cevabını ortaya çıkarabilmektir. Bu bağlamda çalışmada, siyasi istikrarı veya temsilde adaleti en iyi şekilde sağlamış demokratik ülkeler referans alınmakta ve bu ülkelerin siyasi istikrarı ve/veya temsilde adaleti sağlama yöntemleri irdelenmektedir. Bu amaçla giriş bölümünde demokrasi açısından seçimler, seçim sistemleri, yönetimde siyasi istikrar ve temsilde adalet ilkeleri irdelenmiştir. Bu kapsamda yönetimde siyasi istikrarın ve temsilde adaletin öneminden bahsedilmiş ve bu ilkeleri sağlama yöntemlerine değinilmiştir. Ayrıca çalışmanın amacı ve metodolojisi de giriş bölümünde ortaya konmuştur. Çalışmanın ikinci ve üçüncü bölümleri çalışmanın hipotezini oluşturan siyasi istikrar ve temsilde adalet yaklaşımlarının tartışıldığı bölümlerdir. Bu çerçevede her ülke için farklı derecelerde önem arz eden siyasi istikrar ve temsilde adalet ilkelerinin önemi, etkileri ve farklı ülkelerde (İngiltere, ABD, İsviçre, Hollanda) bunları sağlama yöntemleri detaylı olarak irdelenmiştir. Dördüncü bölümde ise, Türkiye'nin çok partili hayata geçmesinden son genel seçimlerin yapıldığı 2015 yılına kadar olan zaman dilimi, tablolar eşliğinde, yönetimde istikrar ve temsilde adalet açısından değerlendirilmeye çalışılmıştır. Sonuç bölümünde ise hem siyasi istikrarı ve hem de temsilde adaleti aynı anda sağlayabilen bir seçim sisteminin olmadığı sonucuna varılarak çalışmanın hipotezi olan“Seçim Sistemlerinin Yönetimde İstikrar ve Temsilde Adalet Üzerinde Belirleyiciliği Var mı?”sorusu olumsuz olarak yanıtlanmıştır. Ancak çalışma boyunca edinilen bilgiler ışığında, siyasi istikrarın ve temsilde adaletin aynı anda sağlanabilmesinin anayasal düzenlemelerle olabileceği kanaatine varılmıştır. Bu düşüncenin oluşmasında İsviçre'de uygulanan Konkordanz Yönetim Sistemi etkili olmuştur. The purpose of thesis is to be able to find out answer to the question of“Are the electoral systems determinative on stability in administration and justice in representation?”In this context, democratic countries that provide best justice in representation or political stability are taken as a reference and the methods of those countries in providing justice and/or political stability are examined. In the introduction part; elections in terms of democracy, electoral systems, the principles of political stability in administration and justice in representation are emphasized. In this context, the importance of political stability and justice in representation is briefly mentioned and the methods of providing these principles are touched upon slightly. In addition, the purpose and methodology of the study is also introduced in the introduction part. The political stability and the justice in representation approaches that forms the basis of the hypothesis of the study are discussed in the second and third parts of the study. In this framework, the importance and the effects of the principles of political stability and justice in representation which has become more of an issue in each different country was examined in detail. Furthermore, the ways of enhancing political stability and justice in representation in varied countries (the U.K, the U.S.A, Switzerland, the Netherlands) have been analysed. As for in the fourth part, the time frame from the change over after the multi-party life of Turkey until the year of 2015 when the last general elections were held was evaluated with charts from the point of stability in administration and justice in representation. As a result; because of the inability to reach an electoral system that can provide both justice and political stability, the answer to the question“Are the electoral systems determinative on stability in administration and justice in representation?”which is the hypothesis of this study is negative. However, it in the light of outcomes, it has been concluded that political stability and justice in representation will be together enhanced by the help of through constitutional arrangements. The Concordance Administration System in Switzerland has been effective in emergence of this idea.
