All praise is due to Allah, and Allah's Peace and blessings be upon the most honorable of theapostles, all his family and his companions This is the summary of the dissertation that is to obtainthe doctoral degree in Islamic law and legal theory, which is entitled as:“The theses of IbnHazmin his debates with other jurists throughout his book al-Muhalla”-from the beginning of the chapter of Jihad to the end of the chapter of Ikrah- (descriptive and inscriptive research). This dissertation consists of apreface, an introduction, three chapters and a conclusion followed by detailed indexes. The prefacediscusses the importance of the topic, and the reasons for choosing it, a literature review, and the plan of dissertation, the applied method in the research and finally acknowledgements and dedication. The introductionentails a short biography of the Imam and a study of his book“al-Muhalla”Chapter Iprovides a contextual study of the term“al-Ilzam”-with its literal definition, technical definition, its authentic conditions, its parts and usages- Chapter II examines methodological principles upon whichIbnHazm bases his theses in his debates with the jurists in the certain chapters of his book. Chapter IIIencompasses the theses of IbnHazm al-Zahiri against the jurists through his book“al-Muhalla”–descriptive and inscriptive research-from the beginning of the chapter of Jihad to the end of the chapter of Ikrahin the book of“al-Muhalla”-(31 chapters) Conclusionevaluates the most important results achieved through this research. Indexesfacilitate the use of this research for the reader. And all praise is due to Allah, the Lord of the Worlds. And Allah's Peace and blessings be upon Muhammad, all his relatives and companions.
