Özet
Malvarlığı değerleri, toplumun temel değerlerinden birini teşkil etmektedir. Çalışmanın konusunu oluşturan hakkı olmayan yere tecavüz (TCK m. 154) düzenlemesi de bu malvarlığı değerlerinin bir kısmını korumak maksadına matuftur. Düzenleme üç fıkradan müteşekkildir ve her bir fıkrada ayrı bir suç tipine yer verilmiştir. Bu suçlarda malvarlığı değerleri, taşınmazlar üzerinden gerçekleştirilen ihlallere karşı korunmaktadır. Çalışma iki bölümden oluşmaktadır. Birinci bölümde çalışmayla ilgili bulunan mülkiyet ve zilyetlik kavramları ve bunların diğer hukuk dallarındaki koruma yollarına, taşınmazların korunmasına yönelik bir ceza normu getiren 3091 sayılı kanuna ve 765 sayılı kanunda yer alan hakkı olmayan yerlere tecavüz düzenlemesine değinilmiştir. İkinci bölümde ise 5237 sayılı kanunun 154. maddesinde yer alan suçların incelemesine geçilmiştir. Birinci fıkrada özel mülkiyetteki taşınmazların, malikmiş gibi işgal edilmesi, sınırlarının değiştirilmesi veya bozulması ve hak sahibi kimselerin taşınmazdan faydalanmasına engel olunması suç haline getirilmiştir. İkinci fıkrada köy tüzel kişiliğine ait veya köylünün ortak yararlanmasına terk edilmiş taşınmazların, zapt edilmesi, bunlarda tasarrufta bulunulması ve sürüp ekilmesi suç olarak tanımlanmıştır. Sonuncu ve üçüncü fıkrada düzenlenen suç ise aidiyeti ehemmiyet taşımadan, suların mecrasının değiştirilmesi halinde vücut bulmaktadır.

Asset values constitute one of the basic values of society. Regulation on invasion of a place or in other words trespassing, (article 154 of Turkish Criminal Code) which composes the subject of the study, aims to protect some of these assets. The regulation is framed in three paragraphs and each paragraph issues includes a different type of crimes. Via this regulation property values are protected against violations occured through immovable properties. The study consists of two parts. In the first chapter, the concepts of property and possession and the ways of their protection in other branches of law, the law no. 3091 concerning the protection of immovable property and the regulation of invasion of a place in the law no. 765 are examined. In the second chapter, the types of crimes mentioned in article 154 of law no. 5237 is analyzed. The crime regulated in the first paragraph of article 154 is the occupation of privately-owned immovable properties by a person acting as if he or she is the owner, changing or destructing the boundaries of the property and preventing the rightful owners from benefiting from the immovable property. The crime defined by the second paragraph is confiscation or management or usage with agricultural purposes of the immovables belonging to the village administration or allocated to the common use of the villagers. In the third and final paragraph, the crime that is regulated arises when a person changes the water-duct regardless of its ownership.
