Özet
Tezimiz, usûl tarihi açısından en verimli olan hicri beşinci asır ve daha sonra gelen tanınmış Şafiî usûlcülerin, ?edille-i erbâa?dan sonra beşinci delil diye adlandırdıkları istidâl delili hakkındaki görüşlerini işlemektedir. Bu dönemlerde yaşayan usûlcülere göre istidlâl kavramının ne anlama geldiği hakkındaki düşünceleri, istidlâlin dayanağı olarak zikrettikleri delilleri, istidlâl ile ilgili aralarında vuku bulan ihtilâflar ve istidlâl için getirdikleri örnekleri sunmaktadır.Eser, önsöz ve giriş dışında üç bölüm ile sonuç bölümünden ibarettir.Girişte hicri V. asra damgasını vuran Şafiî ekolüne tabi bazı usûlcülerin hakkında bilgi verilmiştir.Birinci bölümde istidlâlin tanımı ve mahiyeti ele alınmıştır.İkinci bölümde istidlâlin hücciyeti konusundaki görüşler üzerinde durulmuştur.Üçüncü bölümde istidlâlin kısımları ele alınmıştır.Yine bu bölümün sonunda hicri V. asırdan sonra gelen usûlcülerin ?istidlâl ile irtibatlı olan deliller? diye açıkladıkları şer'î delilerden kısa da olas bahsedilmiştir.

The thesis addresses the the views of the famous Shafîi? methodologists of the 5th age (after hijrah), which is considered as being the most fruitful age of the history of methodology, and the following periods regarding the evidence of ?İstidlâl? (the submission of evidences) named as the fifth evidence by Shafii? scholars after the ?four evidences?. The views of the methodologists of these periods regarding the meaning of the term ?İstidlâl?, the evidences taken into consideration which from the basis of ?İstidlâl?, the disputes rising among them about ?İstidlâl? and the examples on this issue are being presented.The study contains three sections in addition to foreword and introduction.In the introduction part, some information is given about some of the major Shafii? methodologists of the 5th age (a.h.).In the first section, the definition and nature of the ?istidlal? has been addressed.In the second section, the views on the evidence of ?istidlal? are discussed.In the third section the parts of ?istidlal? have been addressed.At the end of this section, the ecclesiastic evidences mentioned as evidences being related with ?İstidlâl? by the post-5th age (a.h.) methodologists are addressed briefly.
