Özet
Tez konumuz olan 6 numaralı Halep şer 'iye sicili Şam'da“merkezi vesaiki tarihîye”de bulunmaktadır. Belgeler 996-999 H-1588-1591 M, tarihleri arasını kapsamaktadır. Toplam 81 sayfa ve 326 adet belgeden oluşan 6 Numaralı Halep Şer 'iye Sicilinin 281-362 sayfaları arasında yer alan belgeler Arapçadan günümüz Türkçesine aktarılmıştır. İncelemiş olduğumuz belgelerin büyük bir çoğunluğunu vakıflara ait kayıtlar oluşturmaktadır. Halep şehrinde o yıllarda yer alan vakıflar sayesinde sosyal, kültürel ve dini hizmetler rahat bir şekilde sağlanabiliyordu. Ayrıca dikkat çeken bir uygulama da huluvvül-örfi uygulamasıdır. Bu uygulamada“Tesis edilen vakıfların gelir getiren gayrimenkullerinin zamanla harap olmasıyla kullanılamaz hale gelmesi sonucu, bu gayrimenkullerin tekrar kullanılabilir hale getirilmesi amacıyla, şahıslara yapmış olduğu harcamalar doğrultusunda gayrimenkuller üzerinde süresiz kullanma hakkı”verilmektedir. Yine vakıflarla ilgili önemli bir belge de kadın mütevellinin faaliyetini anlatan kayıttır. Vakıflarla ilgili belgelerin büyük çoğunluğunu ise vakıflara ait kurumlarda çalışan görevlilerin atamaları ve maaşlarıyla ilgili belgeler oluşturmaktadır. Belgelerin diğer bir kısmında ise esnaflar, gayrimenkul satışları, borç alacak işlemleri, kira, arazi kiralama gibi Halep'teki günlük ticari hayattan önemli kesitlere ait bilgiler yer almaktadır. Ayrıca evlilik, boşanma ve nafaka hakkında aile hayatına dair kayıtlara da ulaşabilmekteyiz. Yine incelemiş olduğumuz belgelerde köle ve cariyelerle ilgili sınırlı sayıda kayıttan edindiğimiz bilgilere göre o yıllarda kaçak köle ve cariyeler de dikkat çekmektedir.

The 6th issue of the Aleppo Shari'a Court Registers, which is the subject of focus of this thesis, is physically located at the central historical achieves in Damascus. The documents cover the dates 996-999 H-1588-1591 M. The 6th issue of the Aleppo Shari'a Court Registers consist of 81 pages and 326 documents; and the documents between the pages 281-362 were transferred from Arabic to modern Turkish. The majority of the documents that were examined during this thesis were the records belonging to the foundations (waqfs) that were operative in Aleppo during the time period. It is observed that many social, cultural and religious services were provided comfortably in Aleppo due to the existence of these foundations. A large part of the income sources of these foundations were provided by the money renerated through rents of real estate, and other service buildings, and the foundations struggled to cover the costs of the maintenance and repairs which happen overtime. Therefore, a remarkable application is the application of“huluvvül-örfi and hukr”, which refers to the“right of the real estates to be used indefinitely by the individuals in accordance with the expenditures made for the purpose of making these real estates, which have become ruins and beyond repair from damages overtime, reusable”. Furthermore, another important document about foundations is the register explaining the operations of the female trustees. The vast majority of documents in the register for the foundations constitute the documents related to the appointments and salaries of the officers working in the institutions belonging to foundations. Other documents of the issued register outlines detailed information regarding important funtions of the daily trading life in Aleppo, such as the tradesmen, real estate sales, debts and payments, rent and land leasing. We also have access to family life and regulations through records about marriage, divorce and alimony. Again, from a limited number of documents we have examined about the slaves and concubines, it was observed that in that time period, there were many illegal men and women slaves in Aleppo.
