Özet
09/06/1932 tarihli ve 2004 sayılı İcra ve İflas Kanunu hükümleri gereğince çıkarılan yönetmelikte konkordato komiserinin nitelikleri, eğitimi, eğitim verecek kurumlar ve eğitimden muaf tutulacaklar ile alacaklılar kurulunun zorunlu olarak oluşturulacağı hâller ve konkordato komiserliği ile alacaklılar kuruluna dair diğer hususlar düzenlenmiştir. Yönetmelik, konkordato komiserliğinin nitelikleri, görevleri, yükümlülükleri, yasak işleri, bilgi ve belge temini, eğitimi gibi konuları kapsamaktadır. Bir borçlunun bozulan mali yapısı sonucu alacaklıların alacaklarını bir program belirleyerek alma konusunda anlaşmalarını mahkemede onaylatmaları olarak özetlenen konkordato, mali yapısı bozulan işletmelerin borçlarını yapılandırıp, mühlet alarak ödeme yapabilecekleri konuma gelebileceklerini ilan ettikleri bir kurumdur. Konkordato komiseri bu süreçte, mahkeme tarafından atanır ve borçluyla birlikte, borçlunun faaliyetlerinde onunla birlikte hareket eder ve en son yazdığı borçlunun mali yapısı hakkında raporun sunulmasıyla müzakereye ve oylamaya geçilir. Mahkeme konkordato kararını vermeden önce, borçluyu, konkordato talep eden alacaklıyı, alacaklılar kurulunu ve gerekli görürse diğer alacaklıları da dinleyerek kararını verir ve ilan ettirir.

In accordance with the provisions of execution and Bankruptcy Law No. 2004 dated 09/06/1932, in the regulations issued, the qualifications of the concordat commissioner, the institutions that will give education and training and the conditions in which the board of creditors will be formed as a requirement, and other matters related to the board of creditors with the concordat Commissioner. The regulation covers issues such as qualifications, duties, obligations, prohibited works, Information and documentation, training of the Concordat Commissioner. Concordat, summarized as a debtor's agreement to obtain receivables by determining a program as a result of the financial structure deteriorating, is an institution in which businesses whose financial structure deteriorating can be restructured and sealed to make payments. In this process, the commissioner of concordato is appointed by the court and acts with him in the activities of the debtor, together with the debtor, and begins to negotiate and vote with the submission of the report on the financial structure of the debtor he wrote last. Before the court decides concordat, it makes the debtor, the creditor requesting konkordato, the creditors ' board and other creditors to hear the decision and make the announcement.
