Özet
İflas ertelemenin yürürlükten kaldırılması ile bunun yerini konkordato almıştır. Konkordato; borçlarını ödeyemeyecek durumda olan borçluların, borçlarının yeniden yapılandırılması olarak tanımlanmaktadır. Konkordatoda iflas ertelemeden farklı olarak alacaklıların söz sahibi olduğu tespit edilmiştir. Farklı nedenlerle konkordato başvurusu reddedilen borçluların konkordato süreçlerinin iflasla sonuçlanması da muhtemel olarak görülmektedir. Konkordatonun iflas ile sonuçlanabilmesi için borçluların borca batık olması gerekmektedir. Bu nedenle konkordato sürecinde borca batıklığın tespiti büyük önem taşımaktadır. Konkordato süreci içerisinde borca batıklığın tespiti Konkordato Komiser Heyeti veya Muhasebe Meslek Mensubu olan bilirkişilerin hazırlamış olduğu rayici değer bilanço üzerinden gerçekleşmektedir. Yapmış olduğumuz çalışmanın amacı; konkordato sürecinde borca batıklığın tespit edilmesi konusunda Konkordato Komiserliğinin yetkinliğinin incelenmesi olarak belirlenmiştir. Bu nedenle Konkordato Komiserlerine bu yetkinliğin belirlenmesi için bir anket formu yöneltilerek, Türkiye çapında 310 Konkordato Komiserinin bu ankete cevap vermesi saplanmıştır. Konkordato Komiserlerinin konkordato süreci içerisinde borca batıklığın tespiti konusunda yetkinliklerinin belirlenmesine yönelik olarak yapılmış olan analiz sonucunda Konkordato Komiserlerinin borca batıklığın tespitindeki yetkinliğinin yaş, cinsiyet ve eğitim durumu ile ilişkisinin olmadığı, meslek, meslekte çalışma süresi, görev yapılan il ve daha önce Konkordato Komiserliği yapmış olma durumu ile ilişkili olduğu belirlenmiştir.

With the abolition of the bankruptcy postponement, it has been replaced by concordat. Concordat is defined as the restructuring of debts of debtors who are unable to pay their debts. Unlike postponement of bankruptcy, creditors have a say in concordat. It is also possible that the concordat processes of debtors whose concordat application is rejected for different reasons may result in bankruptcy. In order for the concordat to result in bankruptcy, debtors must be insolvent. Therefore, the determination of insolvency is of great importance in the concordat process. The determination of insolvency within the concordat process is realized through the fair value balance sheet prepared by the Concordat Commissioner Panel or the experts who are Accounting Professionals. The purpose of the study we have conducted; It has been determined as the examination of the competence of the Concordat Commissioner in determining the insolvency in the concordat process. For this reason, a questionnaire form was directed to the Concordat Commissioners to determine this competence and 310 Concordat Commissioners across Turkey responded to this questionnaire. As a result of the analysis conducted to determine the competence of Concordat Commissioners in determining insolvency in the concordat process, it was determined that the competence of Concordat Commissioners in determining insolvency is not related to age, gender and educational status, but is related to occupation, working time in the profession, the province of duty and the status of having previously served as Concordat Commissioner.
