Özet
1868 tarihinde kurulan Divân-ı Ahkâm-ı Adliye, Türk hukuk tarihinde sistematik bir şekilde temyiz vazifesini icra eden ilk müessesedir. Nizamiye mahkemelerinin temyiz merci olan bu müessese, Osmanlı Devleti'nde kuvvetler ayrılığına, tek yargı düzenine ve adli modernleşmeye doğru gidişin en mühim aşamalarından biridir. 1879 tarihinde Mahkeme-i Temyiz ismiyle yoluna devam eden bu müessese, günümüzde Yargıtay ismiyle yaşamaya devam etmektedir. Bu çalışmanın amacı; Divân-ı Ahkâm-ı Adliye'nin kuruluşunu, teşkilatını, işleyişini ve geçirmiş olduğu tarihi gelişimi gözler önüne sermektir.

Divân-ı Ahkâm-ı Adliye (the Council of Judicial Regulations), which was built in 1868, is the first institution established in order to fulfill the duty of cassation systematically in the Turkish legal history. Establishment of this institution, as the cassation authority of the Nizamiye courts, is one of the most important stages in the Ottoman State towards separation of powers and both uniform and modernization of the judicial system. This institution, which continued its way under the name of“Mahkeme-i Temyiz (the Ottoman Court of Cassation)”after 1879, survives under the name of“Yargitay (the Turkish Court of Cassation)”today. The aim of this study is to reveal the establishment, organization, functioning and historical development of Divân-ı Ahkâm-ı Adliye.
