Özet
Kolluk gücü re'sen icra gibi yetkilerle donatıldığından, temel hak ve özgürlüklere doğrudan müdahale edebilir. Hukuk devleti ilkesi gereği, temel hak ve özgürlüklere getirilen sınırlamaların sınırının belirlenmesi hem bir zorunluluk hem de devletin ödevlerindendir. Ülkemizde genel kolluk kuvvetlerinden biri olan jandarmanın, 2016 ve sonraki süreçte uğramış olduğu değişim, bu değişimin sonuç ve etkileri çalışmamızın konusunu oluşturmaktadır. Bu kapsamda üç bölümden oluşan çalışmanın birinci bölümünde kolluk kavramı ve jandarmanın kolluk kuvveti niteliği incelenmiş, peşi sıra jandarma teşkilatının uğradığı değişimler incelenmiştir. İkinci bölümün odak noktasını oluşturan idari kolluk kavramı ekseninde, jandarmanın kolluk yetkisi temel hak ve özgürlüklere getirilen sınırlamalar açısından tartışılmaya çalışılmıştır. Son olarak idarenin faaliyetleri arasında kolluğun özgüllüğü değerlendirilmiştir. Son bölüm ise jandarmanın geçirdiği değişimin sebepleri üzerinde yoğunlaşmaktadır. Tüm dünyada bir dönüşüm halinde olan kolluk kuvveti anlayışının olası etki ve sonuçları tartışılmak istenmiştir.

Because law enforcement body have the direct execution authority, it is able to interfere on the fundamental rights directly. Pursuant to the rule of law principle, it is both an obligation and a duty of the state to determine the limits of restrictions of fundamental rights and freedoms. The change that the gendarme, one of the general law enforcement officers in our country, has experienced in 2016 and later, the results and effects of this change is the subject of our study. In this context, the concept of law enforcement and the nature of the law enforcement force of the gendarmerie were examined in the first part of the study, which consisted of three chapters, and the changes that the gendarmerie organization experienced were examined. In the axis of administrative law enforcement concept, which is the focal point of the second section, the law enforcement authority of the gendarmerie was tried to be discussed in terms of restrictions on fundamental rights and freedoms. Finally, the specificity of law enforcement was evaluated among the activities of the administration. The last section focuses on the causes of the change of the gendarme. Possible effects and consequences of law enforcement understanding which is in a transformation all over the world have been discussed.
