Özet
Taşınmaz rehni türlerinden biri olan sözleşmeden doğan ipotek hakkı, uygulamada sıklıkla başvurulan real teminat türlerinden biridir. Biz de bu çalışmada dil açısından kolaylık sağlaması ve okuyucunun zorlanmaması adına sözleşmeden doğan ipotek hakkını esas alarak açıklamalarda bulunduk. Bu çalışmada esas olarak ipotekle güvence altına alınan taşınmazda meydana gelmesi muhtemel veya gerçekleşmiş değer düşmesi karşısında alacaklının özellikle Türk Medeni Kanunu kapsamında hangi hukuki imkanlara nasıl bir çerçevede sahip olduğunun belirlenmesini amaçladık. Taşınmazdaki değer düşmesinin belirlenebilmesi için ipotek hakkının taşınmaz bakımından neleri kapsadığının da tespiti gereklidir. Dolayısıyla çalışmada ipotek hakkının taşınmaz bakımından kapsamı ve ipotekli taşınmazdaki değer düşmesi karşısında alacaklının sahip olduğu hukuki imkanları bir arada değerlendirdik. Ayrıca rehin hukukuna dair genel bilgileri de yalnızca konu özelinde ele almaya çabaladık.

The guarantee under contractual hypotec, which is one of the types of immovable pledge, is one of the real collateral types that are frequently applied in practice. In this study, we have made explanations based on the the guarantee under contractual hypotec in order to make it easier in terms of language and not to force the reader. In this study, we mainly aimed to determine what legal opportunities the creditor has, especially within the scope of the Turkish Civil Code, in the face of a probable or realized decrease in value of the immovable secured by a hypotec. In order to determine the depreciation of the immovable, it is necessary to determine what the hypotec covers in terms of the immovable. Therefore, in this study, we evaluated the scope of the hypotec in terms of real estate and the legal possibilities of the creditor in the face of the decrease in the value of the the guarantee under contractual hypotec real estate. In addition, we have tried to deal with general information on the law of pledge only on a subject-specific basis.
