Özet
İncelememiz boyunca af konusunun kavramsal yönü ve tarihsel süreci ele alındıktan sonra lehe ve aleyhe düşüncelere yer verilerek konunun detaylarına geçilecektir. Sırasıyla af kurumunun çeşitleri ve özellikleri ortaya konulduktan sonra eski toplumlardan günümüze kadar affa ne şekilde ve hangi koşullar altında başvurulduğunun genel bir çerçevesi çizilecektir. Af kurumunun, Osmanlı ve Cumhuriyeti Dönemi'nde uygulanma biçimleri ortaya konulduktan sonra mevcut siyasi atmosfer, cezaevlerinin içerisinde bulunduğu koşullar ve sosyoekonomik durum çerçevesinde yeni bir affın koşulları üzerinde durulacaktır. Ardından güncel af tartışmaları çerçevesinde şuan için sonlanmış bulunan barış süreci açısından olası bir affın doğurabileceği sonuçlar hakkında genel bir değerlendirme yapılacaktır. Af kurumunu tüm nitelikleriyle incelerken ve yine Türkiye bağlamında yeni bir affı tartışma konusu yaparken konuyu daha çok; ceza adaletinin gerçekleşmesi, insan hakları ve bu yolla siyasi atmosfer ve toplum açısından yeni bir başlangıcın yapılıp yapılamayacağı üzerinden değerlendireceğiz. Sonuç olarak tüm bu tartışma ve değerlendirmeler ışığında ilan edilecek yeni bir genel affın, topluma sunabileceği imkânları ve fırsatları ortaya koymaya çalışacağız.

Throughout our investigation, after the discussion on the conceptual aspect and historical process of the issue of amnesty, the details of the subject will be elaborated by including the thoughts for and against. After the explanation of the types and characteristics of the institution of amnesty respectively, a general framework will be drawn about how and under which conditions amnesty has been applied from ancient societies until today. Following the argument on application practices of the institution of amnesty in the Ottoman and Republican Period, the conditions of a new amnesty will be discussed within the framework of the current political atmosphere, the conditions of the prisons, and the socioeconomic situation. Then, within the framework of the current amnesty discussions, a general evaluation will be made about the consequences of a prospective amnesty in terms of the peace process that has been finalized today. While reviewing the institution of amnesty with its all aspects and arguing the relitigation of a new amnesty in the context of Turkey, we will evaluate the issue more on the realization of criminal justice, human rights, and in this way whether a fresh start can be made in terms of the political atmosphere and society. All in all, we will try to reveal the potentialities and opportunities that a new general amnesty to be announced in the light of all these discussions and evaluations can offer the society.
