Özet
Bu çalışmada boşanma sonrası çocuklar için verilen nafaka kavramı İslâm hukuku ve Medeni Hukuku kapsamında mukayese edilmeye çalışılmıştır. Çalışma her ne kadar Hanefî mezhebi özelinde olsa da gerekli görülen yerlerde diğer mezheplerin görüşlerine de yer verilmiştir. Çalışmanın ikinci bölümünde tezin ana ekseninde bahsi geçen hidâne ve iştirak nafakası kavramlarını açıklayarak konu ile alakalı olarak yapılan önceki çalışmalara yer verilmiştir. Üçüncü bölümde hidâne ücreti konusu genel hatlarıyla ele alınmıştır. Dördüncü bölümde hidâne ücreti konusu ele alınarak bakılması gereken çocuğun hangi durumlarda ücret alacağı, ne kadar ücret alacağı, nafaka ile sorumlu olanların kimler olduğu ve nafaka ödemedeki sorumluluk dereceleri ele alınmaya çalışılmıştır. Bu araştırmada Medeni Hukukta iştirak nafakası ile İslâm hukukundaki hıdane ücreti konuları içeriksel ve ana başlık olarak birbiriyle örtüşecek şekilde ele alınmaya gayret edilmiştir. Bunun dışında çalışmanın tamamında İslâm hukuku ile Medeni Hukukun bakıma muhtaç çocuk özelinde ortaya çıkan ücret konusu benzediği ve ayrıldığı noktalarda mukayese yapılmaya çalışılmıştır.

In this study, we tried to determine the similarities and differences of the alimony concept given by spouses by comparing it in context of Islamic Law and Civil Law. During the research, we tried to include the opinions of other groups as much as possible while evaluating the issue within the scope of the Hanefî group. In the second part of the study, the concepts of hidâne and alimony mentioned in the main axis of the thesis are explained and previous studies related to the subject are included. In the next section, it is aimed to answer questions such as in what situations the child receives the fee, how long he or she will receive the fee, who is responsible for alimony and in what situations the obligation to pay alimony occurs. The title of the subsidiary alimony in civil law, where the comparison will be made, is expressed in proportion to the topics in the hidâne fee section. Finally, we tried to determine the similarities and differences between the two legal systems by considering their point of view. In the conclusion section, we also expressed the findings we made and ended our work.
