The story has begun with the extracting, copying, mimicking, and creating abilities of thinking machines in the copyright sense. It is possible to see that, due to AI's inherent abilities, that as AI has started to generate visual, literary and musical outputs that allegedly supplant human authors or are indiscernible from human works. However, to create such works, the AI needs to learn and improve itself with the huge amount of data by reading, listening, viewing, and extracting. The main question the one at the core of this dissertation, is whether copyright infringement is an obstacle to the creation of AI works since AI might use copyrighted works for training purposes to subsequently create their own works. infringement will be mostly related to reproduction rights in the AI context. Infringement is also possible in both before the creation of work and after the creation of work. The after the creation of the works section is mostly related to infringing outputs from AI whilst the before the creation of the works section is related reproduction as part of a dataset that uses copyrighted works to train AI. There are three possible ways to avoid copyright infringement before the creation“being the owner of copyrighted work used for training”,“obtaining a license for reproduction”, and“training under copyright exemptions”. To what extent can copyright exemptions be implemented in AI matters and to what extent flexibility on copyright law strikes the balance between the rights holder and the creative future of AI? Additionally, AI-created works might be same as or similar to pre-existing works. This might amount infringing output. This also brings into mind originality, creativity, accountability and responsibility matters in the copyright context when the AI infringes some others' copyrighted work by copying.
